SCC just released Uber v. Heller today. Necessary reading on the unconscionability of contracts. The legal test remains the same: inequality of bargaining power +improvement bargain (para 65) but some detail added. One could say the majority's decision is a shift away from formalism and commercial certainty and may invite more contract challenges by persons in purportedly "weak" positions.
