Elias was in a peculiar situation. He lost his refugee claim, lost his refugee appeal and as a result, his deportation order became valid (enforceable). Immigration Canada was getting ready to deport him back to his home country. Luckily for Elias, it took the government a long time to finalize his deportation documents, and a year after losing his refugee claim, Elias could apply for a Pre-Removal Risk Assessment (PRRA). He came to LC to help him with this application. By th...e time he could submit his PRRA application, Elias’ refugee work permit was about to expire. He wanted to continue working and support himself while his PRRA application was being reviewed by Immigration Canada. When Elias was given his PRRA application, his refugee deportation order became invalid (not enforceable) making him able to submit a new work permit application. We helped Elias to submit this work permit as well. A few months after, the work permit application was refused. Immigration Canada wrote that Elias was no longer eligible for this work permit, because his PRRA was denied. The problem was that the PRRA decision (negative or not) was not given neither no Elias, nor to us his representatives. Calls to Immigration Canada to determine the fate of the PRRA application did not help. We received conflicting information on whether the PRRA was refused or not. Without the decision, by law Elias continued being eligible for a work permit. We filed an application for reconsideration of this negative work permit decision. We had to stress the legal prerequisites for the work permit application in Elias’ case and that he met all of those requirements. The reconsideration request was filed in the midst of Covid19. So what happened? Elias’ reconsideration application was approved within a few weeks, and he was issued a work permit for another year. The decision on his PRRA application has not yet been received.

Maria got refugee protection in Canada because she was in an extra-marital relationship with a woman and her country of birth did not look kindly on this. She then filed for permanent residence and included her husband, Ramon, and their children as her dependants. This ought to have been a typical application, butImmigration Canada refused Ramon’s PR application because they did not believe that Ramon and Maria had a genuine marriage. They cited Maria’s previous relationship ...with a woman as the cause. When Maria reached out to Legally Canadian for help, we were shocked with the reason she was given for the refusal. We took the case and intended to go all the way to the Federal Court to fight this refusal, but just as we were about to go before the judge, the lawyer for Immigration Canada offered to settle that is, drop the refusal and have Ramon’s PR application sent for a re-assessment. Maria wanted to settle since it meant moving the application forward faster. They considered the matter done, and decided to proceed on their own. Alas, within a few months, Ramon’s application was once again refused, and again for the same reason. We were happy to help, and this time we went to Federal Court. So what happened? The judge accepted our claim and found a number of mistakes made by Immigration Canada in assessing and refusing Ramon’s application. The application was sent once again for review, but this time, with explicit instructions from the judge on how to assess it. Let’s call a partial win, since we’re not out of the woods yet. #LCstories
Adil was a Canadian citizen, but lived abroad for many years where he married Hanna. When he returned to Canada, Hanna came with him as a visitor. Adil hired Legally Canadian to apply for a permanent residence for Hanna under the spousal sponsorship application. They wanted to hire a lawyer right away, instead of going on their own. We were glad that they did so, because their application was actually rather risky. They had a significant age difference more than 20 years ...and this is something that can cause Immigration Canada to doubt the genuineness of the marriage and refuse the application. We put together a sponsorship application with emphasis on the genuineness of their relationship, and addressed a number of other issues. Hanna’s visitor status was about to expire (it’s valid for 6 months), so we applied for a work permit, which extended her temporary status. Another tricky issue was that Hanna did not have her police certificate from her country of citizenship in some countries it proves to be troublesome to obtain. This is a real issue for Immigration Canada, so we needed to request an exemption to get around it. So what happened? Application was approved within 12 months without any additional requests from Immigration Canada. #LCstories
