For the profession: Bill 161 includes Amendments to the Law Society Act; its passed 2nd reading & its now "being considered" by the Standing Committee on Justice Policy- here are the proposed changes (although nothing on Bylaw 4!!): https://www.ola.org//parliament-/session-1/bill-161/status (...) ... Schedule 14 - Law Society Act The Schedule makes various amendments to the Law Society Act.... The Act is amended by adding sections 61.1.1 to 61.1.4, respecting the practice of law or provision of legal services through a firm, as defined by a new definition added to section 1 of the Act. Section 62 of the Act is amended to give Convocation authority to make by-laws governing the practice of law or provision of legal services through a firm. Other amendments to the Act include the following: 1. Subsection 35 (1) is amended to increase the maximum fine that may be imposed on a licensee in the event of a contravention of section 33 (prohibited conduct) from $10,000 to $100,000. 2. Sections 42 (review: professional competence), 49.2 (audit of financial records) and 49.3 (investigations) are amended to permit a person conducting a review, audit or investigation, as the case may be, to enter former business premises of a licensee or group of licensees and require people who formerly worked with a licensee or group of licensees to provide information. 3. Subsection 48 (1) is re-enacted to add to the circumstances in which a licensees licence may be summarily revoked. 4. Amendments are made to section 49.12 to add to the circumstances in which specified persons may disclose specified information respecting audits, investigations, reviews, searches, seizures and proceedings. Subsections 49.12 (2.1) and (2.2) are added to specify that certain information that is subject to solicitor-client privilege or that may tend to criminate or establish a persons liability to civil proceedings may nevertheless not be disclosed in some of those circumstances. 5. Clause 62 (3) (a) of the Act, which requires that copies of the by-laws made under the Act be filed in the office of the Attorney General for Ontario, is repealed. See more

Driving after weed... read on and take greater care! As summer is in full-swing, families and friends head to the highways so that they can enjoy camping, hiking, or other fun activities. People using the highways are entitled to be safe, and should reasonably expect that the other motorists on the highway are operating their vehicles in a safe fashion. Public safety is the impetus behind the recent amendments to the Criminal Code and Ontarios Highway Traffic Act in relation... to drug-impaired driving. With the legalization of marijuana in Canada slated for later this year, it was necessary for the government to implement new drug-impaired driving rules, to match those relating to alcohol. The Criminal Code has been amended to introduce new offences for drug-impaired driving. These changes came into force on June 21, 2018. The legislation creates three new offences for when a driver has a prohibited concentration of drugs in the blood within two hours of being behind the wheel. The concentration levels of THC in the blood will range from 2 nanograms (ng) but less than 5 ng of THC per millilitre (ml) of blood for a summary conviction offence, to a hybrid offence for 5 ng or more of THC per ml of blood. There is a third (hybrid) offence related to a combination of 50 milligrams (mg) of alcohol per 100 ml of blood plus 2.5 ng or more of THC per 1 ml of blood. Starting on July 1, 2018, drivers under the age of 21, or novice drivers of any age (with G1, G2, M1, or M2 licenses) are prohibited from having any presence of cannabis in their system, as well as other drugs that can be detected by an oral fluid screening device. With this amendment to Ontarios Highway Traffic Act, the province is employing a zero tolerance approach to drugs for all young and novice drivers, such as it has already done for alcohol. Importantly, the zero tolerance approach also applies, as of July 1, 2018, to all commercial drivers. Drivers of vehicles that require an A-F class license, or vehicles that require a Commercial Vehicle Operators Registration, and/or road building machines, are prohibited from having any presence of alcohol, cannabis or other drugs detected by an oral fluid screening device when operating these types of vehicles.
