I am often asked about Family Mediation and why I believe it is a very viable alternative to other methods of resolving family disputes. There are many reasons... for this - let me focus on one for the purposes of this post: a skilled mediator is able to truly "explore", "get into", "dismantle" the dispute by not simply accepting the parties' positions ("this is what I want") but also by delving into their interests and concerns. The better understood the dispute, the more likely it is to be addressed at its very core, and resolved. Family Mediation is a much more dynamic process when it comes to a consideration of such factors - a judge in family court simply does not have these opportunities - he/she is faced with the parties' positions and may have limited information from which to glean their motivations and what actually drives them. #familymediation #FDP #mettamediation See more

Screening for a potential imbalance of power is absolutely essential when it comes to Family Mediation. Why? Because the foundational principle of a fair bargai...ning process is that parties come to settlement discussions based on self-determination and in positions of power balance. In other words, neither can have an advantage over the other, based on pressure or behaviour of any kind. Domestic violence has many faces, some more subtle than others, but no less impactful. Only thoughtful screening can alert the Mediator to a potential imbalance in the bargaining process. #familymediation #mettamediation #powerimbalance See more

Many Ontarians are unaware that in many cases of separation and divorce, Family Mediation is a viable method of addressing all resulting issues, as an alternati...ve to Court. It is important that Family Mediators and, in fact, all FDR professionals (FDR stands for Family Dispute Resolution) work on educating the public in this respect, and on propagating Family Mediation as a more peaceful, often-more-timely and cost-effective method of handling family law issues. Mediation is NOT suitable for every case. There are disputes which simply cannot be mediated and anyone who tells you mediation is for everyone is mistaken. There are situations which cannot be addressed without the involvement of the Court. That being said, family mediation is a viable option for many families. #familymediation #mettamediation #AJJakubowskaFamilyLawyerandMediator
