July 14, 2020 - Announcement from IRCC A temporary public policy has been issued exempting certain foreign nationals in Canada from certain requirements when they have fallen out of status. This public policy has 2 elements related to restoration:... An exemption from the requirement to apply for restoration within 90 days of losing temporary resident status for all foreign nationals (former workers, students and visitors) in Canada. Temporary residents whose work permits, study permits or authorization to stay expired after January 30, 2020 will have until December 31, 2020 to apply to restore their status instead of the current 90 days. Interim work authorization. While all in-Canada foreign nationals who have lost their temporary resident status within the specified timeframe will be exempted from the requirement to apply for restoration within 90 days of losing their status, the authority to work while their restoration and work permit application is being processed will be available only to those who were previously assessed as workers (that is, those who held a work permit in the 12 months prior to their application for restoration of temporary resident status), have a job offer, and have submitted an employer-specific work permit application supported by a Labour Market Impact Assessment (LMIA) under the Temporary Foreign Worker Program or an LMIA-exempt offer of employment under the International Mobility Program. This public policy comes into effect on July 14, 2020, and remains in effect until December 31, 2020.

Canada has collected biometrics (fingerprints and photos) on most foreign nationals applying for temporary or permanent residence since December 31, 2018. Having biometrics helps immigration officers verify people’s identity, which makes processing applications easier and simplifies entry for legitimate travelers. Applicants, including those in Canada who will be travelling outside the country, can also give their biometrics at a visa application centre (VAC) in any country that they are legally allowed to enter. Canada has one of the most extensive networks of VACs worldwide, with 160 locations in 108 countries.

The Student Direct Stream (SDS) is an expedited study permit processing program available to legal residents living in China, India, Philippines or Vietnam who want to study in Canada at a post-secondary designated learning institution (DLI) and who meet specific requirements by providing upfront documentation. The service standard for SDS processing by Canada Immigration is 20 calendar days. Only applications received electronically are eligible for SDS processing. Applicants must reside outside Canada at the time of application. Applicants must also be able to provide upfront proof of payment of the first year’s tuition, a Guaranteed Investment Certificate (GIC) of at least CAN$10,000, language test results, and upfront medical and police certificates, if required, based on the applicant’s country of residence or program of study.
