It has come to our attention over the last week, that there is a lot of confusion in regards to the responsibilities of dental offices as employers when utilizing temporary staff. The confusion lies between whether or not the office is responsible for handling income tax deductions, CPP contributions and EI premiums. According to Canada Revenue Agency, the employer is responsible for ensuring these deductions and remittances are submitted to the Canada Revenue Agency, as you... would for a permanent employee, unless you're working with an agency that pays the temporary workers directly. The majority of temporary employees are not considered self-employed or independent contractors according to the Canada Revenue Agency. There is a criteria they follow in determining whether or not a temporary employee is considered an independent contractor or not. Based on numerous discussions with representatives at the Canada Revenue Agency, temporary dental workers fall within the criteria of a temporary employee not an independent contractor due to the nature of work and how it is conducted. Therefore, it is required that deductions and remittances are submitted to the Canada Revenue Agency and that Records of Employment are issued to temporary workers that help out at your office. In terms of Records of Employment, all employers are legally required to submit Records of Employment for temporary employees if: - an employee requests an ROE and an interruption of earnings has occurred; - an employee is no longer on the employer's active employment list; - Service Canada requests an ROE; or an employee has not done any work or earned any insurable earnings for 30 days. Both the submission of deductions and remittances as well as the submission of Records of Employment for temporary workers is NOT optional. This is a requirement by law and if your office is not complying or failing to submit Records of Employment in a timely manner, it could face severe penalties and in extreme cases, imprisonment for up to 6 months. Today officially marks our 2nd birthday! It's been an amazing 2 years of working with and getting to know everyone!
