The average DUI conviction will cost a person well over $35 000 over three years. This does not include the difficulty either maintaining or obtaining employment as the result of not being able to pass a criminal background check. The defences to impaired driving, over 80, and refuse to provide sample are extremely technical. Make sure that you obtain legal advice before you plead guilty. Time and time again I see lawful gun owners who have stored their firearms in what is technically a legal fashion charged with unsafe storage by untrained police officers. They are put through the Court system, only to be ultimately acquitted. Despite being ultimately acquitted they are out of pocket thousands of dollars in unrecoverable legal costs. Their firearms are usually damaged in the process of seizure, storage and testing the firearms. ... The entire world is told that you have firearms in your home, putting you and your family in harm's way of a home invasion by criminals who want your guns. You are forever in the various police databases labelled as "caution: firearms." You will be treated as a gun-toting criminal who merely hired a lawyer to "get off" your gun charges. You will be stopped regularly. Police will insist on illegally searching your home and car. Police responses to your home will be treated as "high-risk", which puts you and your family in danger. The internet is awash with "legal advice" from non-lawyers about how you "can" store your firearms. What you need is legal advice from someone about how you SHOULD store your firearms. This is the kind of legal advice that avoids a charge in the first place, rather than gets an acquittal after a $10 000 week-long trial. Remember, the police are not required to complete or to have passed even the basic PAL course in Canada. They are permitted to possess firearms by virtue of their employment, not a license. I have yet to encounter a police officer outside of the CFO who actually understands the storage laws in this country. Despite this shortcoming of training, the police are entitled to lay charges based upon only their understanding of the storage laws. These charges then land in the "zero-tolerance" environment of the Crown's office. It is best to avoid the situation entirely. Appeared for a client yesterday who was charged with cultivation of 20 000 pot plants in a hydroponic greenhouse that he purchased for that purpose. The crown wanted four years in the penitentiary. Following a contested sentencing hearing he received two years less a day conditional sentence without house arrest (curfew only).
