"Bank of Nova Scotia and Canadian Imperial Bank of Commerce say they will fill at least 3.5% of senior executive and board positions in Canada with Black leaders by 2025. The two banks confirmed they plan to sign the BlackNorth Initiative CEO pledge, the brainchild of a group led by Wes Hall, a prominent Black executive who founded Toronto-based Kingsdale Advisors. "A coalition of Black executives is launching a new fund to make long-term investments to support Black-led organizations and businesses across the country, seeking to combat systemic racism in corporate Canada. At least three dozen Black Canadian business leaders have joined together to create the Black Opportunity Fund, in partnership with the Toronto Foundation, a community organization that supports philanthropy. The group has begun work to raise capital and hopes to secu...re backing from businesses and philanthropists as well as governments. The funds founders are seeking to create a large and sustainable pool of capital to back structural solutions to fighting racism. "To those employers, leaders, and politicians who consider their organizations to be diverse, I urge you to look at the makeup of your board, your management team, your supply chain, or your cabinet and tell me how many Black people do you see? We need to set specific targets and timelines to ensure Black representation in the boardrooms and executive suites across Canada and get companies to sign on to meeting those targets. It is important for Black people to see people lik...e themselves in the boardrooms and on senior executive teams to know that it is possible. When there is no representation it leads to the conclusion that there are systemic biases. It is not enough to say you have a diversity policy or that you happen to have a Black person in charge of X. In fact, generally, the executive in charge of diversity in a company is not Black because there are no Black people in their ranks to fill that role. It is also not acceptable to say we cant find a Black person who fits the requirements of a position. Those arguments didnt work to address the gender diversity divide. When companies are mandated or have the desire, they find a solution. To be clear, this is not an ask for a handout, or even a hand up. It is a call to remove the systemic barriers that keep capable people, who happen to be Black, from contributing. No doubt some will shy away from participating for fear of controversy or because they continue to deny anti-Black systemic racism exists. If we are to end the systemic oppression of Black people, we need the courage to step outside of the system. If you do not use the platform you have been given to force change and implement the fixes, then you are just as guilty as those who constructed the system."

"Over the longer term, federal and provincial governments need to modernize our public income security programs and employment standards to align with todays labour market, providing coverage to all workers and at adequate levels. A massive initial step in the right direction would be to simplify and streamline access to existing income benefits. Every year, $2-billion in existing federal benefits is left on the table by people who need them most. Too many people either don...t know theyre eligible or encounter language, literacy, digital or other barriers that prevent them from obtaining this much-needed income. Just look at the numbers: Canadian families struggle to pay for their childrens postsecondary educations; but every year, almost two million children are not receiving the Canada Learning Bond, with its grants of up to $2,000 a child. Between 10 per cent and 12 per cent of Canadian adults dont file taxes; that cuts low-income individuals out of more than $1.7-billion a year in existing benefits, such as the Canada Child Benefit and GST rebates, that can give them greater economic control over their lives. Its estimated that 75 per cent of eligible Canadians dont participate in the Registered Disability Savings Program; theyre missing out on up to $90,000 in government bonds and matching grants. For millions of people, accessing these and other existing programs could mean the difference between penury and economic security. Take one program the Canada Child Benefit. Not only does it provide up to $6,400 a child per year, it also allows retroactive claims for up to 10 years. Piecemeal systems prevent many of the people who most need these programs from accessing them. A more sensible approach would be for governments and employers to work together to make them more accessible to Canadians in the work force. Governments cant solve these problems on their own. Employers, the private sector, non-profits, workers themselves and labour unions all have important roles to play. But governments must demonstrate intentionality by acknowledging the problem, mobilizing data and research to accurately diagnose it, and inviting interested stakeholders from all sectors to the table to design solutions. The mere existence of programs is of little use if they arent being applied as intended."

In spite of the closure of the Courts because of COVID-19, they are hearing urgent matters and matters in writing. This matter was both: urgent (because of an upcoming sale of the property) and the hearing occurred in writing. ... Your civil litigation file is not necessarily stalled by the COVID-19 Court closures if there are no urgent issues to be heard. One way to move your file forward is to make use of the process of arbitration. With the launch of the Estates Arbitration Litigation Management ("EALM") initiative, spearheaded by Hull and Hull LLP in Toronto, estate litigation clients can now have certain procedural issues in their non-urgent matters decided by an arbitrator using the process of a...rbitration. Further details are available on Hull and Hull's blog (see their post from April 13, 2020 below). An arbitration hearing occurs outside of the Court system. The adjudicator in an EALM arbitration is a senior estates litigator, who charges a maximum hourly rate for her/his time. All parties to the litigation must consent to the arbitration of the specified issues. Orders made during an arbitration can be converted into Court orders. Rights of appeal, though, are limited or non-existent, depending on the terms of the arbitration agreement. Arbitration is also available as a means of moving non-urgent litigation cases in some other areas of law, including commercial litigation, along while the Courts remain closed to non-urgent matters. Since Wills/Powers of Attorney that were witnessed virtually were not compliant with Ontario law, they were able to be successfully challenged in Court (and deemed invalid). However, the law should not revert to its prior archaic requirement of an in-person signing once the pandemic passes. It is nearly the end of the month. Given the COVID-19 pandemic, we have received several inquiries from small business clients about their commercial leases and what their options are if they cannot afford the upcoming rental payments. This is particularly the case for small business clients who are not considered by the Province of Ontario to be "essential businesses or services," or who rely on foot traffic / in-person interactions for the generation of their revenue. Fo...rce majeure clauses are a common inclusion in commercial leases. The present pandemic may qualify as a force majeure, depending on the wording used in your lease. As the COVID-19 pandemic spreads, one of the most important things we can all do to slow the spread is to take social distancing steps. With confirmed cases reported in Hamilton, we at Beeksma Law are preparing for social distancing. For clarity, no members of our team have COVID-19 or have a need to self-isolate. For client meetings, we are prioritizing video conferencing for our client meetings as much as possible. If you have a smartphone or webcam on your computer, then y...ou can meet with us from your own home. If a video conference is a first meeting, then you will be asked to take a plain selfie and photos of your ID and email them to the office before the meeting. All currently-scheduled meetings will occur via video conference, unless original commissioned signatures are required, necessitating an in-person meeting. Clients will be emailed a video conferencing link in advance of the meeting to facilitate this. There are some meetings that must be in person (for example will signings). These will continue, on an as needed basis, at the office until further notice. We ask that you advise as to whether or not you are experiencing cold, flu or gastroenteritis symptoms, and if so, then we will reschedule your in-person meeting until after your symptoms have cleared. If you are self-isolating or ill with COVID-19, then we would ask that you obtain clearance from your doctor before setting up an appointment. If you are currently well but are (a) in the elevated risk category or (b) are concerned that you may have difficulty with a COVID-19 infection, then you are welcome to consult our office to review your current estate planning documents. As our office is mostly remote in nature, it will be business as usual in our firm, with the exception of the aforementioned changes and to the extent that any closure of the Superior Courts of Justice occurs.
