When drafting a Will, there may be a gift that is left to a specific institution for a charitable purpose. But what happens if that institution, after making the Will, changes its name, location, or perhaps fails to exist? The doctrine of cy-pres can be applied if the original charitable purpose no longer exists, being impossible or impracticable. The doctrine allows the court to apply the gift to a charity which is similar to the original charitable purpose.... Note that the court would have to take into account ‘general charitable intention’ before cy-pres can be applied if the institution ceased to exist before the gift has taken effect (i.e. before the person dies in the case of a Will and the Will remained unchanged).
