New rules and regulations coming to Canada in 2021
You pay your auto insurance premiums expecting your insurer to cover you when you need benefits. If the insurer unreasonably fails or refuses to provide you with your benefits, you cannot sue your auto insurer for bad faith for not honouring the insurance contract. This is not fair. Did you know that in Ontario there is a deductible on a person's pain and suffering who is innocently injured in a car collision? The amount increases each year. For 2021, the secret deductible on pain and suffering now stands at $39,754.31. This means that if a jury appraises a person's loss of enjoyment of life and pain and suffering from being hit by a drunk driver at $70,000, the defendant insurance company only has to pay $30,245.69. This is an unfair tax on innocently injured people. Why shouldn't the negligent driver who caused the injury pay the deductible?

The "secret deductible" you may not know about could significantly affect your auto insurance claim if you are injured by a negligent driver. If you drive an automobile, you have liability insurance. This means that if you cause a collision and hurt someone, your insurance will pay the damages to the person you hurt. But, there's a catch. ... In third party insurance claims there is a deductible on pain and suffering damages. In 99.9 percent of third party claims, an insurance company defends the claim and pays out damages caused by its insured driver. That sounds pretty good, right? What is not fair is that there is a deductible on the innocent person’s pain and suffering damages. This means that if the injured person’s pain and suffering damages are fairly assessed to be $70,000, the insurance company of the bad driver who caused the injuries does not need to pay the first $40,000 of the damages. It may seem unbelievable, but it is the case. There have been a number of unusual situations over the years where a person is injured in or around a motor vehicle and has been found eligible for benefits under their motor vehicle policy, despite the fact that they were not driving at the time of their injury. Did you know that it is common for Long-Term Disability (LTD) benefits to last for only two years? It may seem unfair, but most LTD policies contain a provision where benefits will only continue to be payable past the two-year mark if you are unable to perform the essential duties of any occupation for which you are suited by training, education, and experience. In an attempt to improve traffic flow, highway speed limits have been increased to 110 km/h on portions of the 402, the QEW, and the 417 here in Ontario. Before heading out, there are some things you should keep in mind as a driver. Paying attention to the posted maximums, keeping a safe distance between cars, and respecting the new speed limits are all especially important as drivers adjust to the new maximum. Fines, impoundment, and criminal charges will all be applicable should you be found to be driving in excess of 150 km/h and you may lose your entitlement to certain insurance benefits should you be injured in a collision. Have you ever wondered how long you have to alert insurance companies or a lawyer about an incident? There are important timelines you should be aware of if you plan on taking legal action. For example: - If you’ve been hurt in a car collision and need to claim for accident benefits, you need to notify your insurer within 7 days of the collision. - You must submit an application to your insurer for accident benefits within 30 days.... - You have 120 days from the date of the car crash to put the at-fault driver on notice of your intention to sue. - If you have been denied long-term disability benefits, you may have 1 year to start a legal action. - Generally, you have 2 years from the date of your injury to start a legal action. Is it possible to reduce the jail population without sacrificing public safety? The answer would appear to be 'yes'. The past several months have brought changes to the Ontario justice system as we have all had to adapt to the realities of living through a pandemic. Increased use of technology has been one such notable change. Another has been a change in approach to holding or releasing nonviolent offenders prior to trial. ... Overcrowding in jails has been a concern for some time and, in light of Covid-19, it once again became an issue for consideration as crowded conditions increased the risk of infection and illness among inmates. Because there has been no measurable increase in crime as a result of this change in policy, it seems that Covid-19 has given us the opportunity to test the long held belief that it is possible to reduce the jail population without sacrificing public safety.
