The recipient of the child support owed in the Power case showed persistence that many who are owed child support cannot afford to pursue. The uncommon and precedent setting jail sentence for the delinquent father/payor in this case is long overdue. https://nationalpost.com//nova-scotia-father-who-owes-2500... Planning for the future? Prenuptial agreements are more common than you think for to-be-wed couples. These contracts help both parties establish ownership over their respective assets prior to marriage so that, in the event of divorce, each party's entitlements and responsibilities are clearly outlined. ... These domestic contracts do several important things including: 1) Create the desired rights and responsibilities division of assets on separation; 2) Protect family wealth and businesses; 3) Establish value brought into the relationship (common law or legally married). To learn more about whether a prenuptial agreement is right for you both, click the link below for more info: www.bortolussifamilylaw.com/lega/marriage-contracts-prenups

In Family Court, a final law decision is made at trial after several mandatory conferences and steps in accordance with the Family Law Act. Family Law Arbitration can streamline the process so that a binding final decision can be made in a more summary manner. When both spouses agree on the process, they can choose a Family Law Arbitrator to hear their evidence and make a binding decision on the issues they cannot agree on.... This process is performed in a private and confidential setting rather than in the open & public court system. The Family Law Arbitrator’s authority is derived from legislation that requires the parties to sign an Arbitration Agreement which outlines the issues that can be decided upon. The involved parties have the option to try mediation first, then move to arbitration if there is little or no progress or agreement possible. Alternatively, the parties can bypass mediation and go straight to arbitration. The Family Law Arbitrator is usually a senior Family Law lawyer with many years of specialized experience. The arbitrator is selected based on credentials, training and a reputation for competence and fairness. Want to learn more about the process of mediation and arbitration vs. mediation? Can an unmarried person in a romantic relationship still be liable for support payments? According to Latner v. Climans, the Ontario court has said "yes." The myth that no legal obligations to pay support arise from a romantic relationship where both parties keep their own residences and reside together intermittently has been dispelled. ... The court found that the couple had cohabitated together off and on for 14 years, even though they owned separate homes. With this, the court ruled that they were in a committed spousal relationship, and spousal support of $53,077 per month was ordered to be paid by Latner. The appeal court did not interfere with the findings of the case but limited the duration of his support payments to 10 years instead of indefinitely. Why choose family arbitration? One of the main reasons is privacy. Parties who choose this process usually prefer to have the details of their personal life and their financial affairs dealt with confidentially rather than through the public court process. ... Arbitration allows a private and confidential hearing which many separating couples (especially those with higher profiles or sensitive issues) often prefer. Both parties must obtain independent legal counsel prior to beginning the arbitration process. Learn more at www.bortolussifamilylaw.com/arbitration

Mediation may be a more economical and effective alternative to court for many divorcing couples. The court system has only become more backlogged with the current pandemic. With that, the ability to get before a Family Court judge in a timely manner is prompting people to find a way to resolve their issues as quickly as possible. ... As long as both parties genuinely want to resolve their issues, they can find a seasoned and skilled Family Law mediator to help guide them to agreement. The terms agreed upon during mediation can be included in a binding separation agreement. Both parties then obtain independent legal advice from their respective lawyers on the terms agreed upon and the drafting of the separation agreement. Once signed and witnessed, this separation agreement will allow them to move forward with their lives. Divorce during COVID-19: Back to School Are you separating and still in disagreement over whether your child should physically return to school? The court's ruling in Phelps v. Childs referred to the government’s decision to open schools and send children back to the classroom. ... Separating parents who cannot agree whether or not their child should return to the physical classroom face the dilemma of whether to risk the high cost of bringing their case to court. Many of these cases arise when the child suffers from specific health vulnerabilities and the parents disagree on their attendance in their school's classroom due to the COVID-19 pandemic. Mediation is an alternative to the court process that allows parents to (with the skill and assistance of a Family Mediator) work through the issue in order to agree on the best plan for their children. This method allows parents an affordable and expedient way of maintaining control over the decision which will affect their children. Through mediation, parents can agree on terms that a court may or may not be prepared to order. Have questions? Contact us today at (416) 987-3300 or visit www.bortolussifamilylaw.com for more information. For more on Phelps v. A memorandum of understanding (MOU) outlines the terms arrived at in mediation including the responsibilities and entitlement of each of the parties. An MOU is not legally binding but is often the first step toward creating a legally binding contract. Parties can use an MOU to outline the expectations leading up to an agreement, and eventually a domestic contract. ... Unlike an agreement, which can be legally binding whether written or verbally agreed upon, MOUs only become legally binding when they are properly signed and witnessed. Independent legal advice will help ensure that the contract is enforceable. Have questions? Contact us today at (416) 987-3300 or visit www.bortolussifamilylaw.com for more information.

One parent should not be able to leave the country with a child without the consent of the other parent or a court order. A Separation Agreement or a Court Order can contain terms preventing one parent from taking the child out of the country without the other parent’s written consent and restrict a child's mobility - including the child's place of residence. Without such legally enforceable documentation, you risk the child's wrongful removal from the country or a unilateral move of the child's residence. The lawyers at Bortolussi Family Law can help incorporate protective clauses in your parenting agreement or a court order. They can also act quickly and efficiently to prevent the removal of your children from the country should this distressing event be threatened. Contact us today at (416) 897-3300.

Family Arbitration, for instance, is a process where the parties in dispute agree to retain a Family Arbitrator to hear their evidence and submissions in a private hearing.
