Condo Owner fined $27,000 for Roommate! If you or a family member, own or live in a Condo, that does not allow rentals or has met their allotted number of rental units based upon their bylaws, be very cautious about having a roommate. A recent Civil Resolution Tribunal decision awarded $27,000 in fines to Strata for the owners breach of the rental bylaw by having a roommate. The Owner was fined $500 per week as it was deemed the roommate was paying rent even though it wasn't... paid monthly to the other party in the suite or the owner. The Tribunal stated "The RTA does not require a written agreement for an arrangement to be a tenancy. If someone occupying less than an entire strata lot under a verbal agreement with the owner, tenant or occupant is paying monetary rent or providing other value to the owner, that individual is renting and in violation of Bylaw 32.2 and 32.10." So, if your "roommate" is helping with expenses and your Strata does not allow rentals, or has a cap on the number of rentals allowed, be very cautious as it could cost you in the long run.
