Mediation - WHAT IS IT? From Wikipedia, the free encyclopedia For other uses, see Mediation (disambiguation).... Mediation is a structured, interactive process where an impartial third party assists disputing parties in resolving conflict through the use of specialized communication and negotiation techniques. All participants in mediation are encouraged to actively participate in the process. Mediation is a "party-centered" process in that it is focused primarily upon the needs, rights, and interests of the parties. The mediator uses a wide variety of techniques to guide the process in a constructive direction and to help the parties find their optimal solution. A mediator is facilitative in that she/he manages the interaction between parties and facilitates open communication. Mediation is also evaluative in that the mediator analyzes issues and relevant norms ("reality-testing"), while refraining from providing prescriptive advice to the parties (e.g., "You should do..."). Mediation, as used in law, is a form of alternative dispute resolution resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement. Disputants may mediate disputes in a variety of domains, such as commercial, legal, diplomatic, workplace, community, and family matters. The term mediation broadly refers to any instance in which a third party helps others reach an agreement. More specifically, mediation has a structure, timetable, and dynamics that "ordinary" negotiation lacks. The process is private and confidential, possibly enforced by law. Participation is typically voluntary. The mediator acts as a neutral third party and facilitates rather than directs the process. Mediation is becoming a more peaceful and internationally accepted solution to end the conflict. Mediation can be used to resolve disputes of any magnitude.

Divorce/Separation - There's so much going on for us as adults when our marriage breaks down, but when we can't shelf our own S_ _T long enough to make sure our kids aren't the ones to suffer the most, then what are we doing? Sadly, the toxicity that may exist between couples before ending their relationship, is likely to continue during the process of separation/divorce, since the process itself is so, so hard under whatever defines a 'normal' scenario, and only amplified w...hen hatred takes over. In my opinion, divorce may be a relief in some ways for some kids just to get away from the anger, but what if that same toxicity continues after separation and that same anger for each parent towards the other prevails? Our kids are faced with so much pressure as a result of our complex lives today, then we impose our adult 'stuff' on them just to add more to their pile, resulting in lingering years of similar toxicity that's existed historically.

DIVORCE - To work in the simplest format - a joint, uncontested divorce means you're both on board with getting your final divorce. To get your final divorce you are required to be separated for 1 full year, with the exception of IF you're filing under abuse or adultery. To get your final divorce, one of you are required to have resided in the province that you're filing in for 1 full year. To get your final divorce, you have no outstanding financial or property issues between you. Your final divorce severs your marriage license and allows you to remarry again if you so choose. A SEPARATION AGREEMENT - this requires negotiating the outcome of WHAT your marital assets are made up of, WHO is retaining what, and WHO owes what to the opposing person and WHEN will things transact. It includes a detailed parenting plan if you have kids, and it includes the support obligations between you, both child support and/or spousal support. Calgary Divorce Solutions can help with both.

The cost of going through a separation process in a fair and time efficient manner is even more important now than it was prior to Covid. With all of the uncertainty in the world today and our efforts to continue to move on with our lives, not all of us are in a healthy, productive relationship and by staying, it can often result in an environment that didn't start out to be toxic, but ends up there simply out of feelings of not having a cost effective choice. We don't advocate for people to get divorced, but the reality is, divorce exists, but the options for choosing a process that isn't out to take you to the cleaners, looks to encourage a lengthy battle, can often result in retaining enough respect for one anther that if you have children, you're still able to successfully co-parent without a boat full of resentment. Covid has made us all cost conscious for everything we do, going through a separation can also be obtained in a lesser dramatic, chaotic way, than the traditional litigation way.
