On the one hand, this could be good news for lawyers, but on the other hand the court system was already severely backed up before the pandemic lock down. A flood of new claims could easily overwhelm a system that was already overwhelmed. People should stand up for their rights but consider all forms of Alternative Dispute Resolution: mediation and arbitration. Speak to your lawyer about pursuing your rights in the most efficient way possible, not just filing a claim and waiting at the end of a very long queue.

This is a disappointing decision, but cannot say I am surprised. They have been talking about a unified family court for many years and it just never seems to get off the ground. This time we were very close. Overall the government should invest money in the system and I would expect there is a good chance money could be saved. For example, we still file documents the way we did when I started to practice almost 25 years ago. Also, make med/arb mandatory for all people, especially family law, and make it truly mandatory and create disincentives for litigation. Business as usual cannot be maintained, the system is broken.
