International recruitment is big business, growing in lockstep with global migration. Last year, the federal government granted 340,220 temporary work permits. More than half restricted the migrant to working for one employer. It also issued 358,190 study permits. About a quarter of the work permits were issued to lesser-skilled workers under the temporary-foreign-worker program. Approvals for such recruits have dwindled in the wake of a controversy five years ago, when some ...employers were found not to be hiring enough Canadians. The federal government then put stricter limits on the number of low-skilled workers that employers could bring in under the program. Partly as a result of that crackdown, study permits which allow people to work for any employer, for limited hours and only short-term are the new hot seller for recruiters, who can then steer the students to low-skilled jobs with their employer clients. Last year, the federal government issued almost 40 per cent more study permits than it did in 2015. Major Canadian service-sector employers, corporate farms and career colleges use recruiters because they want migrants to fill jobs and classrooms but they don’t want to deal with the hassle and government paperwork involved. Recruitment agents have taken on so much of that function that several migrants who spoke to The Globe said most major businesses simply won’t hire or sponsor them directly. A Subway franchisee in Aldergrove, B.C., which also hires mostly foreign nationals, was fined $5,000 for underpaying workers after an investigation by the province last year. That business had to remit $7,000 in back pay to 18 employees from two locations. Employers looking to hire or sponsor foreign workers are often required by government to advertise the jobs first. In a survey of government job websites last month, The Globe found 221 jobs advertised at 67 Subway outlets ...in B.C. alone an average of 3.3 full-time job openings per location. Nearly half were for food-service supervisors or restaurant managers categories that earn foreign nationals points toward permanent residency. There were 98 postings just for restaurant managers at Subway locations nationwide, which is more than all the management jobs advertised by Tim Hortons, McDonalds, Burger King and A&W combined. Subway has 3,161 locations in Canada, which makes it the second-largest fast-food business. The B.C. Employment Standards Act states, A person must not request, charge or receive, directly or indirectly, from a person seeking employment a payment for employing or obtaining employment. The federal government also said in an operational bulletin last year regarding the TFW program’s low-skilled jobs component: Workers cannot be charged any recruitment fees (i.e. fees for finding the foreign national a job, not fees related to applying for a work permit).

Q. How much does it cost to recruit a foreign worker? The cost of recruiting a foreign worker varies, and is based on career, country of origin, requirements of the federal Temporary Foreign Worker (TFW) program and the fee charged by the third-party representative. If a recruiter claims that they can find you temporary foreign workers for free, they are likely passing on the fees to the workers. This is illegal in B.C. It’s important that you do research and calculate the expenses specific to your job posting before you start looking for a temporary foreign worker. TFWP: Down 18 per cent compared with 2019 Between January and April of 2020, Canada issued just over 33,000 work permits under the TFWP. The top 5 source countries were Mexico, Jamaica, India, Guatemala, and the Philippines. Mexicans accounted for 41 per cent of all these TFWs. Some 66 per cent of the 33,000 work permits were issued to agricultural workers.... Total TFWP arrivals are down 18 per cent compared with the same period last year which is almost certainly a function of the COVID-19 pandemic. IMP: Down 16 per cent Over 76,000 work permits were issued under the IMP, with 27,000 (36 per cent) going to Indian nationals. Rounding out the top 5 source countries are France, China, the U.S., and the U.K.. Brazil and South Korea ranked closely behind. The Post-Graduation Work Permit (PGWP) remains the leading stream of work permits obtained under the IMP. It accounted for some 35 per cent of all IMP work permits issued at the start of 2020. This figure is even larger when you account for the work permits issued to the spouses of PGWP holders. The PGWP is highly coveted among international students because they can gain professional work experience in Canada, and use that experience to strengthen their immigration applications. Given that Indians are the leading source of Canada’s international students, it comes as no surprise they are also the leading source of work permit holders under the IMP. Overall, total work permits issued under the IMP are down 16 per cent compared with the first four months of 2019.
