Caritas Law 26.01.2021

Criminal Code - Section 320.27 - If a police officer has a reasonable suspicion that a) you have alcohol or a drug in your body, and b) that you have driven a vehicle at all in the preceding 3 hours, they may demand that you provide breath or other samples. To refuse to provide that sample results in the same outcome as being convicted of DUI (you will lose your license for at least a year, among other things). Furthermore, it is a lot easier for the prosecutor to prove that ...you refused to provide a sample, than it is for them to actually use the sample. So don't drink and drive; and if an officer demands a road side breath sample, don't refuse. Ask to speak to a lawyer every step of the way, but be advised that you will likely only get to talk to a lawyer after the road side sample is taken, and before the real sample is taken at the station. Merry Christmas, Happy New Year, and Be Safe.
