An Update on the Concept Plan submission: Early today, the KGPC and ClubLink submitted an agreed to proposal on the management of the Concept Plan evidence to J...ustice Labrosse which he has accepted. The City of Ottawa has no objection. The process designed allows the judge to determine, based on the KGPC submission letter of December 8, 2020, if the ‘Concept Plan’ is necessary to support his reasons on the 40 Percent Agreement. He has indicated that he will be back to all parties next week with his decision on this matter. We expect that should he think the Concept Plan is not necessary, he will dismiss it and will release his decision on the 40PA. Should he see value in the Concept Plan, it is only then that our motion will proceed which would include representations from all parties on its validity. Justice Labrosse has already stated he is available to hear the motion the first week of January. As a result, the risk of delay suggested yesterday is mitigated but the courts access to the evidence is protected. This was the Coalition’s original intent in early October when we uncovered this evidence and sought the agreement of the other parties to have it admitted to the court.
