We would like to clarify some misinformation that is circulating as a result of the recent ONCA decision in R. v Sullivan and R. v. Chan, 2020 ONCA 333 This is a complex legal issue, but there's no need to be alarmed yet, because intoxication is NOT a defence to sexual assault. The way the decision has been portrayed by media and some politicians is incorrect and creating unnecessary alarm and fear. It’s worth noting that the cases this appeal stemmed from, Chan and Sulliva...n, did NOT involve sexual assault. They were two individuals who experienced psychosis after ingesting mushrooms and a prescription medication, respectively, with no way to forsee the consequences of their actions. While in an automatous state, they tragically attacked their family members. Very different circumstances from what the law was intended to punish, which was why it needed to be challenged and overturned.
