Anyone watching my Facebook page the past few days might think the only thing I have been doing is watching comet Neowise (and eating croissants). While it is true I have spent my evenings looking up at the sky, the past few days I have also been attending the American Association for Justice Convention (American Trial Lawyers Association). It has been held virtually this year, and the content is as good as ever. There were a number of great speakers today presenting various... aspects of representing clients with brain injuries. The speakers range from lawyers talking about the legal system and presenting the case, to medical experts talking about advanced imaging, neuropsychological testing, and biomechanical aspects of brain injury. I enjoyed all of the information presented, however one of the more exciting topics was about a new biomarker test for concussion and more severe brain injury as well. A peer reviewed study has been accepted for publication in Neurology-- The Journal of the American Academy of Neurology. Researchers tested a number of markers, including neurofilament light (NfL) and made some potentially significant findings: Concentrations of NfL were increased in patients with subacute and chronic TBI; NfL distinguished patients with TBI from controls at 30, 90, and 180 days; NfL levels at enrolment in study showed a relationship to TBI severity and functional outcome; Increased concentrations of NfL correlated with MRI brain Volumes, DTI measurements, and likely rate of brain atrophy. A single brain injury may cause long-term axonal degeneration which could be detectible for months, and possibly up to 5 years. Perhaps most exciting of all, it can be done with a blood test. Hopefully this research holds up and we will finally start seeing a blood test that can be administered in the emergency room or doctor’s office to confirm brain injury. An excellent conference. As COVID-19 swept over our country, there has been uncertainty in a lot of areas including No-Fault Benefits and both the rights of the injured person and the rights of the insurance company. Below is an excerpt from this article, which highlights some takeaways. the following conditions should be met for the provision of virtual care to SABs claimants during the Emergency:... Virtual care provided should be appropriate and effective: Virtual care may be provided by licensed professionals in lieu of in-person care, where reasonable and necessary during the Emergency to meet the medical/rehabilitation needs of the claimant and where it is supported by the health service provider’s regulatory college and has been approved by an insurer, acting reasonably. Informed consent: Where virtual care is provided to a claimant in lieu of in-person care, it is important for health service providers to clearly explain what the virtual treatment will involve and its objectives, any limitations of virtual treatment when compared to in-person treatment and how the fees for virtual treatments will impact the claimant’s entitlement to future treatment after the Emergency (e.g. to what extent virtual treatment will erode the amount available to them for future treatments). Transparency in requests for pre-approval and billing of goods and services: When seeking pre-approval or billing for goods and services, health service providers should specify whether services are proposed to be or were provided through virtual care, (e.g. using available Health Claims for Auto Insurance attribute billing codes as a proxy to identify care that was delivered virtually, INIndirect for services provided by telephone or video conference and SDSelf directed for services provided using tapes, videos, etc.). A lot of this is may seem like common sense, but there was uncommon nonsense coming from some insurers early on in the pandemic. Hopefully this will answer questions and allow injured people to get the help they need during this difficult time.
