Updates from teleconference with Regional Senior Justice Ellies We can expect a formal memo shortly, but for now the highlights include: electronic filing is here to stay, may be worth investing in software that allows you to make bookmarks (Adobe DC Pro) as SCJ judges will come to expect this from all the electronic filings. Continue to be mindful of the document naming protocol to ensure electronic files are named and filed easily. The court thanks all those who have been... quick to accommodate to the new requirements and appreciates counsel’s ongoing cooperation. There will soon be further personal protective requirements for in-person attendances at SCJ which will include everyone wearing a mask at all times, irrespective of the plastic barriers and physically distancing, as well as face-shields. This may cause counsel to pursue remote hearings more often, and that will be strongly encouraged. Chief Justices from SCJ, OCJ, and OCA are discussing potential options for streamlining PPE and expectations for in-person and virtual attendances in all 3 levels of courts, although each Judge will maintain his/her own control over their individual courtrooms.

As we work on getting back into court rooms as safely as possible in North East Region, we want to remind lawyers and clients accessing the court house to bring and wear a mask, and that you must complete a COVID screening assessment each day you attend a court house building in-person. There is an online screen that you can do found at: https://covid-19.ontario.ca/courthouse-screening/... If you do the online self-assessment, you simply show the result to the security folks stationed in the building, and you won’t need to complete a paper version.

Dear Member of the Legal Community, On August 5, 2020, the Justice Services Online platform will expand to enable the online submission of close to 400 more types of civil and family court documents. The new services, Civil Submissions Online and Family Submissions Online, will provide simple and quick ways to electronically submit court documents, at every step in a case, in any new or existing: civil action or application in the Superior Court of Justice (SCJ); and f...amily proceeding in the SCJ or Ontario Court of Justice (OCJ). Users can pay court filing fees online securely by debit or credit card. Individuals can also use the system to request a fee waiver certificate or submit documents with an existing fee waiver certificate. By making it possible to submit most civil and family court documents online, the Ministry is increasing efforts to protect the health and safety of Ontarians by reducing the need to attend a courthouse in person. The new services complement Civil Claims Online and Family Claims Online and replace some email filing processes established in response to COVID-19. While courthouses will continue to accept in-person filings, we encourage you to use Justice Services Online to file and issue civil and family court documents. Representatives participated in a site visit at the OCJ and SCJ in Timmins today to discuss specific measures that can be implemented to ensure protection against COVID transmission as we move toward transitioning back to in-court and in-person attendances. Tomorrow’s visit will review the Cochrane facilities. Next week another assessment relative to space capacity and other workspace issues.... Bottom line: you likely won’t recognize the courtrooms, there are many changes that will be implemented, and inevitably some growing pains that come with those changes. Please write to us if you would like to hear more details, or participate in the next virtual CLA executive meeting for a more comprehensive debrief.

Good afternoon, please see the message below from Regional Senior Justice Ellies. Thank you. ------------- I am writing to provide some clarification with respect to our regional Notice to the Profession that was updated and posted on our court’s website on May 13, 2020.... It has come to my attention that there is confusion as to whether certain family law applications are being processed by the court in our region. The notice refers specifically to divorce applications only. I would ask you to advise your members that the court is, indeed, processing all family law applications. However, I would also ask you to remind your members that, pursuant to the Emergency Management and Civil Protection Act, the premier made an order suspending, among other things, the time limits set out in the Family Law Rules for responding. Therefore, all family applications will be dealt with by following the protocol set out in paragraphs 5. c. and d. of the notice relating to divorce applications, which read: By virtue of an order made under the Emergency Management and Civil Protection Act, the time limit prescribed for responding to a divorce application has been suspended, effective March 16, 2020. Nonetheless, the suspension of time is subject to the discretion of the court. Where no response has been received to a divorce application within the time prescribed, CSD will notify the trial coordinator for the centre in which the application has been filed. The trial coordinator will arrange a case conference with the parties at which time the presiding judge may impose a deadline for the filing of responding materials. Where the responding party fails to attend the conference or does not meet the deadline, the application may proceed as being unopposed, at the discretion of the presiding judge. Finally, I would ask you also to convey my apologies to your members for the confusion created by the notice. Despite these difficulties, Windsor Law students remain eager and ready to gain practical experience in the legal sector. Taking on a law student on a contract basis is a cost-effective way to ensure that you can continue to fulfil the needs of your clients. As a law school committed to our students and our legal community, the University of Windsor Faculty of Law has created a new opportunity to pair legal employers requiring short-term support, with students keen to build on practical experience. These opportunities will be mutually beneficial from a financial perspective of the employer, and also provide students with an excellent opportunity to build their entrepreneurial skills and put their practical legal skills to good use while earning some modest remuneration. BEST PRACTICES FOR REMOTE HEARINGS In April 2020, FOLA, along with the Advocates’ Society, the Ontario Bar Association, and the Ontario Trial Lawyers Association, created the joint E-Hearings Task Force to review technologies that can help ensure Ontario’s justice system continue to function during and following the coronavirus pandemic. IMPORTANT UPDATE FROM SENIOR REGIONAL CROWN Please see the message below from Dale Cox Dear Justice Partner,... The ongoing COVID crisis has led to a number of initiatives designed to allow the court system to function both remotely and more efficiently. One such initiative involves the creation of a new generic Crown email address for each Crown’s office in the Province. The new generic address for the Timmins office is [email protected]. I would invite you to use this new generic email address for the purpose of making disclosure requests and submitting general correspondence to my office. In the event that you are already dealing with a specific Crown or staff member in relation to a matter, I would suggest that you continue to correspond directly with that individual. The generic address is also intended to permit the service of Application and Motion materials in accordance with the Rules of the Ontario Court of Justice and Superior Court of Justice. The Ontario Court of Justice recently released a new Bail Hearing Protocol that is effective May 11th, 2020. This protocol provides for a greater reliance on written material and directs bail hearing participants to share information with one another electronically. I would encourage you to utilize the new generic email address for this purpose unless, of course, you are dealing with a specific Crown on the day of the hearing, in which case relevant materials can be provided directly to that Crown. For example, if you have a bail matter scheduled three days from now and don’t know which Crown will be addressing the matter, you can send materials to my office via the generic email address. I have tried to include the defence counsel that we deal with most frequently as recipients of this email. I invite you to share this communication with anyone that I may have missed and would ask Nancy and Sharon, in their capacity as CLA co-presidents, to share this with the local Bar as a whole. Received this morning from the Superior Court of Justice - Chief Justice has issued an order suspending court hearings in the Superior Court until July 6th (same date as OCJ) Part of the notice advises: Given the on-going public health situation due to COVID-19 and the uncertainty as to when it will be safe to return to courthouses, the SCJ will not resume in-person hearings of other matters until July 6, 2020, at the earliest. It will, however, continue to hear matters vir...tually, and expects to shortly further expand the scope of matters that will be heard virtually. The LSO has made some CPD programs available to members, free of charge. The LSO has released complimentary CPD programs, both live and on-demand, that directly address issues related to COVID-19. They have released four free full programs and two more full programs will be released in the coming weeks. There are also ten standalone pre-recorded sessions that assist p...ractitioners in operating a remote legal practice. Dear members, Our colleagues to the south have worked out an arrangement whereby we will be able to provide inmates in jails with cell phones for their use. Details will be finalized, but the Powers that be have agreed in principal to allowing this. ... If you have any old cell phones that you are no longer using, we would be happy to collect them and deliver them to the jail when we are given details as to when and how we can do so. This is more important than ever - given the difficult situation with clients being able to reach us (can’t call collect to a cell phone) and to be able to stay in touch with friends and family members. The phones should be cleaned and purged of any personal information. If you are unsure of how to do so, please contact the Law Librarian. There is a drop off box located in the back entrance of the Law Library at 48 Spruce St. N in Timmins. It is located on the ledge on the first set of stairs. We have just been advised that the provincial government through the Lieutenant Governor in Council made an order under s. 7.1 of the Emergency Management and Civil Protection Act suspending limitation periods and procedural time periods. We anticipate hearing from the Ontario Court of Justice soon. In discussion with our local OCJ Justices today we will follow the provincial direction once received, and will pass on all information as soon as we have it. So far, locally some of our law offices have chosen to close for a period of time, some are remaining open while others are closing the doors to the public but not closing the operations. FOLA Day Recap On February 20th, 2020, approximately 60 lawyers from law associations all across Ontario descended upon Queen's Park for a full day of meetings and events. After some networking over breakfast, FOLA members received a recap of key issue and a session on Lobbying/Advocacy 101 with Fasken's Lindsay Aagaard before heading in to watch Question Period. ... FOLA then hosted a luncheon reception for all MPPs and staff where both the Honorable Doug Downey, MPP (BarrieSpringwaterOro-Medonte) and Ontario's Attorney General and Gurratan Singh, MPP (Brampton East) and the NDP critic for the Attorney General said a few words. At 1:30, individual members began breaking out into various groups and headed off to meetings with individual MPPs, Cabinet Ministers, and Ministers' staff. In all, 26 separate meetings were held!
