Question: Do Waivers Need a Witness? Answer: There are some legal documents for which you need a witness present (for example, the proper writing and signing of a will), but a waiver of liability is not one of them. The main thing to remember when you have people sign a waiver or any other legal agreement is that they must have capacity. This means that they must fully understand the agreement and have the capacity to enter into it, understanding its consequences. If someon...e is not old enough, they will not have capacity to enter into an agreement, and thus you cannot enforce the terms of the agreement upon them. In this case, it is helpful to put something in the agreement saying that if someone is under the age of majority (depending on the rules of your jurisdiction), they cannot agree to the terms.
