Landlord and Tenant Board Update: "The Executive Chair of Tribunals Ontario has advised that there will not be any in-person hearings at the LTB before September. He also indicated that after the Emergency Order is lifted (whether that’s July 22 as currently planned or some other date in July), the Board will then start scheduling eviction hearings and clear the backlog. Since the lifting of the Emergency Order will, in any event, be effective July 31, it means that enfo...rcement of pending eviction orders (those obtained before March 17 when the Emergency Order first issued) will, for all practical purposes, begin August 4, 2020. Small Claims Court Update! Settlement conferences: On June 2, 2020, the Small Claims Court will begin scheduling remote settlement conferences in non-urgent matters only where:... 1) All parties to the action agree to proceed with a remote settlement conference; 2) Each defendant has: filed a defence or was noted in default in the matter prior to March 16, 2020; 3) All parties agree to rely solely on the pleadings as filed and served. The Court will consider any request that meets the three above criteria, even if no settlement conference had been previously scheduled in the case. Steps for Scheduling a Settlement Conference: 1) One party must submit the request form, available on the Superior Court of Justice website, to [email protected]. 2) No matter which party or representative completes the form, all parties must agree to the method of hearing indicated on the form. The form must be signed by all parties or their representatives in order to be considered. It is expected that most conferences will take place by video conferencing. A limited number may be held by telephone conferencing. A device with a camera and a microphone, plus access to WiFi/an internet connection, will be required for participation by video conferencing.

In response to COVID-19, as an interim measure, with support from the Superior Court of Justice and the Ontario Court of Justice, the Law Society is pleased to launch an emergency family law referral telephone line to provide assistance to people who are self-represented (SRLs) and who are trying to determine whether or not their family court matter meets the criteria to be heard by the Court on an urgent basis and, if so, how to proceed in making their request. This emergency service will connect SRLs with family lawyers, working on a pro bono basis, who will provide 30 minutes of legal advice specific to determining whether or not their family court matter is urgent and referrals to other available legal services. Additional services may be available from the lawyer on a private retainer basis, from Legal Aid Ontario, from the Law Society Referral Service or the private unbundled family law roster (www.familylawlss.ca). This interim measure is offered by the Law Society in association with the Ontario Bar Association and Toronto’s Family Law Advice and Settlement Counsel project, with support from the Family Lawyers Association and the Federation of Ontario Law Associations. Premier Doug Ford is expanding Ontario’s state of emergency to shut down all non-essential services to curb the spread of COVID-19. Only essential manufacturing and supply chain providers as well as shops like supermarkets, pharmacies, LCBO outlets, and takeout restaurants would be allowed to remain open when details are finalized Tuesday. He has also confirmed that kids will not be returning to school for April 6,2020. Updates will be provided.... Ford made the decision after a phone call with Prime Minister Justin Trudeau Sunday night and in consultation with Dr. David Williams, Ontario’s chief medical officer for health.
When people can’t work together and make self sacrifices for the greater good, our Government May have no choice but to rely on the Emergencies Act. BEWARE- Landlord and Tenant Board Information: Tenants- Although the government is providing forms of support financially during this pandemic does not mean you are not required to pay your rent. It will become due at some point. Landlords- Bombarding your Tenants with threats is no way to deal with a crisis or people in crisis. It is acceptable to have a paper trail in the event Tenant relationships go sour however before issuing threats be sure to have exasperated all othe...r options. Resolution: Both the Landlord and the Tenants need to work together. Everyone is scared of the unknown and it doesn’t do any good to be at each other’s throats. There is some wiggle room for discussions, talk to one another, come up with agreements to lessen the burden on everyone. Offer 1/2 rent on the first and the remainder on the 15th. Threats of not paying rent or eviction will get you no where and ultimately make matters worse when things begin to return to normal. Here is where the court system is currently sitting:... - Small Claims Court Closed - Superior Court Open, do not attend if directed not to, do not attend if you are exhibiting signs, call for confirmation of appearances and check daily dockets - Jury Duty Summons; disregard no Juries will be sitting at this time - All in- person LTB hearings will be rescheduled. Impacted individuals with upcoming hearing dates will be notified by staff via email to make the necessary arrangements. Parties should contact their tribunal or board for more information on the new policy. - POA Courts- closed until April 3,2020. Anyone with matters scheduled will receive a new Notice by mail to the address the court has on file. If your information has changed contact the court to ensure you get your new dates. They are asking everyone not to attend court at this time. In addition, extensions have been put in place to accommodate the current situations. Take care of yourself and one another.
