What is the role of a lawyer in a real estate transaction? You may only meet with your lawyer once or twice during your real estate transaction, but don’t let that mislead you. Lawyers play a critical role in the smooth processing of real estate transactions from the time of the offer through to possession day, though much of the work they do remains behind the scenes. When you finalize an offer for a purchase and / or sale your Realtor provides your transaction documents to ...your lawyer, your lawyer then reviews them to ensure no legal issues have been missed. They then conduct a handful of searches required to transfer the title to you, including checking the title for any registrations or discrepancies that need to be accounted for. This ensures there are no surprises upon possession. The lawyer also works with the mortgage lender to prepare the legal documents required to register and transfer the mortgage. It’s that time of year when we get to pretend the 5 LBS of candy we’re buying is for trick-or-treaters.
