As of today, March 30, 2020, the Landlord Tenant Board processing centre is shut down. This is a very fluid situation and no timeline is projected. While I trie...d to Efile an L1 today, the payment system page would not load however I am advised that it is an I.T issue and not a result of the Board not accepting applications. I was lucky enough to manage an email exchange with an LTB personnel, you cannot call and speak to anyone. The Board Continues to accept applications and if you have an issue including N4’s and L1’s, you should be filing the documentation either by Efile or Fax. Currently, the Board is stuck on February 3, 2020. Once normal operations resume, N7’s for serious impairment of safety will take priority. Once it is safe for staff to return, staff will begin processing applications and scheduling hearings IN THE ORDER IN WHICH THEY WERE RECEIVED. This is important, you do not want to be at the back of the wave of applications to be filed, there will be a serious backlog. I will make a separate post regarding serving N4’s. The current global pandemic may warrant working with otherwise excellent tenants to aid in retaining them as tenants. NOTHING about this situation gives license to unruly behaviour, interfering with peaceful enjoyment, lawful rights of the landlords, damages or tenants who simply choose not to pay their rent because of some campaign for a rent strike. This will not stop the Limitations clock or extend the time to file a Defence. If you are approaching limitations, you still need to preserve your rights by filing a claim and any current actions will still be subject to orders already issued or timelines imposed by the rules.

The Ontario Paralegal Association is pleased to announce a change in the Small Claims Court. As of January 1st 2020, the Small Claims Court monetary jurisdictio...n will increase from $25,000 to a maximum of $35,000. This change by the Ministry of Attorney General of Ontario is a great step forward for access to justice. The minimum amount of a claim that may be appealed to Divisional Court will also increase from $2,500 to $3,500. Litigants who started a claim in the Superior Court will be permitted to transfer their case to Small Claims Court if the claim falls within the monetary threshold. These changes will cut down wait times in courtrooms, and give parties more cost efficient representation options such as paralegals. The Ontario Paralegal Association is pleased with the current changes and looks forward to continuing its work with the Ministry of Attorney General to further promote and make access to justice work for Ontarians. O. Reg. 626/00: SMALL CLAIMS COURT JURISDICTION AND APPEAL LIMIT Stills shows the $25,000 and $2500 respective limits however, I assume this to be true given the source. This is great news, wish it was $50,000 but better than nothing.
