For nearly 20 years, the Department of Justice has successfully been able to avoid a legal challenge to Canada's Child Support Guidelines. If you are a non-custodial parent paying child support, did you know that the federal Child Support Guidelines (which determine the amount of child support you pay) are skewed in favor of custodial parents? The Guidelines are supposed to divide the financial responsibility for children based on each parent’s relative ability to contribute to the obligation. However, the Guidelines do not do this and ultimately, result in unjustifiably high amounts of child support. The failure of the Guidelines in this regard is the basis of an upcoming action challenging the legality of the Guidelines.
