Not that we play favourites, but if Double Diamond Law had a favourite client, WAG might just be it. Whistler wouldn't be the same without these real- life superheroes. ~ DDL

"(A) B.C. Supreme Court judge this week answered one of the other mysteries sparked by his death: provincial law allows for both of the dead man's partners to be considered spouses despite a criminal prohibition against polygamy. ... Duncan's lengthy decision on a lawsuit filed by Widner's secret spouse for a share of his estate pulls back the curtains on a double life spent evading the scrutiny of both romantic partners and police. ... "Despite the fact that the deceased lied about his marital status and covered up his involvement in the Hells Angels, Ms. Boughton trusted him about everything else," Duncan said in her decision." https://www.cbc.ca//hells-angel-killing-spouses-estate-1.5

"Vance’s office is expected to receive Trump’s tax returns this week, a turn of events that is no doubt extra terrifying to the 45th president given that the D.A. recently hired attorney Mark Pomerantz, who is best known for successfully prosecuting John Gotti and other white-collar criminals. Unlike Trump’s multi-paragraph screed, Vance responded to the Supreme Court’s order with just three words: The work continues."

"Fitzpatrick was killed on Feb. 22, 2009 while working as a rock scaler on a hydroelectric project near Toba Inlet, north of Powell River. ... (A) rock measuring 1.8 metres across fell on Fitzpatrick from above ... Investigators found that Kiewit had been running the site with a "reckless disregard" for safety. Just one day before the fatal rockfall, another boulder had tumbled down the same steep rock face, seriously damaging a piece of heavy equipment, and Fitzpatrick had spoken up about safety issues on the site in the weeks before he died. ... Police opened an investigation in 2014. Five years later, Crown prosecutors announced criminal charges against the company, former manager Gerald Karjala and engineer Timothy Rule. The charges have been called unprecedented for a business of this size."

"(L)egal experts appear divided in what the clause except in cases of impeachment means. The conventional wisdom and centuries of treatises and textbooks tell us that when the Constitution says that the president can pardon ‘except in cases of impeachment’ means that the criminal process and the impeachment process are separate, and the president can only pardon crimes, Brian Kalt, an expert on constitutional law and presidential history, and a law professor at Michigan State University, told ... He can’t stop an impeachment or undo an impeachment conviction, but he can still pardon any related crimes. https://www.ctvnews.ca//can-president-trump-issue-pardons-

"Supreme Court on Monday declined to step in to halt the turnover of his tax records to a New York state prosecutor ... the apparent culmination of a lengthy legal battle that had already reached the high court once before. Trump’s tax records are not supposed to become public as part of prosecutors’ criminal investigation, but the high court’s action is a blow to Trump because he has long fought on so many fronts to keep his tax records shielded from view." https://apnews.com//supreme-court-donald-trump-tax-rercord

"The reforms contained in Bill C-22 include repealing mandatory minimum penalties for 14 of the 67 offences to which they currently apply, allowing for greater use of conditional sentence orders and requiring police and prosecutors to consider alternative measures, such as diversion to addiction treatment programs, for simple possession of drugs."

Rick Snyder, who ran the state at the time of the devastating 2014 Flint water scandal, has been charged in the crisis that led to the Legionnaires' disease outbreak that killed 12 people. "Paul Woods, who was fired on Monday as president and CEO of London Health Sciences Centre (LHSC), has filed a $2.5 million lawsuit against LHSC, claiming he was dismissed in bad faith and that he notified board chair Amy Walby about his travel to the United States since March last year, first notifying her in June, then twice afterward."

"An emergency room doctor in Whistler is calling on the B.C. government to restrict travel from other provinces after seeing a "worrying" number of patients from Ontario and Quebec over the holidays. ... A public health advisory has been in place across B.C. since Nov. 19 cautioning against all non-essential travel. Provincial Health Officer Dr. Bonnie Henry has said skiers should stick to their local slopes for example, people who live in Metro Vancouver should limit themselves to the North Shore mountains. "For the second time, the Resort Municipality of Whistler (RMOW) has filed a notice of civil claim against a homeowner over short-term rentals in a residential neighbourhood. The claim, filed in the Supreme Court of British Columbia on Nov. 4, alleged Rachel Leor Greenfeld (who legally changed her name to Karmel Leor Greenfeld on Nov. 26, 2019) uses a variety of websites to market and rent a residential property to tourists and other guests for non-residential stays, includ...ing temporary stays of less than four weeks, in exchange for payment. The property, located at 7291 Spruce Grove Lane, is zoned RS6, which does not include the commercial rental of a detached dwelling or auxiliary residential dwelling unit as a permitted use. Further, Greenfeld does not have a business licence to market or otherwise accept payment for renting the property" See more

"Pennsylvania officials can certify election results that currently show Democrat Joe Biden winning the state by more than 80,000 votes, a federal judge ruled Saturday ... U.S. District Judge Matthew Brann in Williamsport, Pennsylvania, turned down the request for an injunction by Trump’s campaign. In his ruling, Brann said the Trump campaign presented strained legal arguments without merit and speculative accusations ... unsupported by evidence. In the United States of Am...erica, this cannot justify the disenfranchisement of a single voter, let alone all the voters of its sixth most populated state ... Our people, laws, and institutions demand more. Trump’s personal attorney, Rudy Giuliani, and campaign senior legal adviser Jenna Ellis pointed to the decision as a positive development in their effort to push the case relatively quickly to the U.S. Supreme Court." https://apnews.com//election-2020-joe-biden-donald-trump-c

"As President Donald Trump’s chances of reelection dwindled last week, his campaign began blasting out a nonstop stream of emails and text messages that led to a website raising money for an election defense fund to contest the outcome. ... But the fine print indicates much of the money donated to support that effort since Election Day has instead paid down campaign debt, replenished the Republican National Committee, and, more recently, helped get Save America, a new polit...ical action committee Trump founded, off the ground. The unusual way the Trump campaign is divvying up the contributions has drawn scrutiny from election watchdogs, who say Trump and his family are poised to financially benefit from the arrangement. While the Democratic National Committee and Biden’s campaign are also soliciting funds to defend the election results from Trump’s legal battles, the majority of it will go to the DNC’s legal account, with a portion sent to the party’s general fund where it could be used to pay for ads. Whereas the lion‘s share of the money raised by the Trump’s campaign is expected to go to Save America, a PAC launched by Trump on Monday. And from there it could wind up in the personal accounts of the outgoing president, Ivanka Trump, Jared Kushner, and sure, maybe even Don Jr. and Eric" https://www.vanityfair.com//donald-trump-legal-defense-slu

"Matthew Sanderson, an election law expert at Caplin and Drysdale in Washington, D.C., said the judge’s ruling was expected. City and county attorneys explained very effectively what seemed to be simple misperceptions about the vote-counting process. The plaintiffs asked for an extraordinary order from the court and failed to make a case that would have warranted a suspended vote count or a new election. This is the third time a court has had to dismiss Trump supporters’ completely fabricated claims of voting problems in Detroit ... Once again, the court record showed conclusively the Detroit City Clerk ran a fair and proper election."
