Ducharme Law 10.01.2021

More news...Ducharme Law remains in our office space at 51A Armstrong, but we've downsized our space considerably! Our main door is now on left side of the building, facing the river directly. We'll be getting the sign folks around to slap the logo up and post our hours (which haven't changed). Here's a look at the new lobby!

Hi all, just an update to let you know that Covid19 precautions are still in effect. In-person appointments are limited to cases where a "wet-ink" signature is required, and appointments are available by Zoom, FaceTime, and telephone.

Ducharme Law 21.12.2020

Hi Folks, a belated update on the status of things here at Ducharme Law. We are down to a skeleton crew of staff and are practicing physical distancing. This means among other things that we are not answering phones right now. If you call the office please leave a message and I will get back to you, usually same-day. Court Services: We just got word that the Ontario Court of Justice (where most of my family law files are heard) will not be returning on May 29, 2020. Instead ...court will be returning for hearings on July 6, 2020. I am treating this as a tenative date, with further delays possible. Urgent Matters: Only urgent matters are being heard at any level of the courts right now. In criminal court, this means that cases where an accused is in custody are being given higher priority. Bail hearings and reviews are probably taking up most of the time, due to the threat of Covid in jails. Defence counsel are doing great work in this regard. In Family law, urgent matters are less clearly defined, but my interpretation is that unless there is a threat of immediate harm to a child, or immediate risk that one partner is going to hide or illegally move assets, the matter is not urgent. The definition of "urgent" was already strict in family law, and it's gotten stricter. Child protection matters where apprehensions are necessary fall under this category, so some child protection matters are moving ahead. Custody/Access: IN the midst of the covid pandemic, courts are making it clear that they expect court orders regarding access to be followed, despite the risks of travel. Basically if you screen positive for covid testing, you should alert the other parent about the situation and discuss how you both want to handle the situation. This may include transferring the children as planned. If you test positive for covid-19, then quarantine rules may supersede your access orders. Please consult the health unit and your lawyer if you have concerns. With regard to access, whether an order is in place or not, the courts have made two things very clear: they expect co-parents to work together through the crisis for the benefit of their children, and they will punish parents who try to take advantage of the crisis to modify the access situation to their own benefit. As always, when in doubt, consult your lawyer.
