Wills & Estates: Be careful what kind of provisions you are inserting in your will. A clause within the will can be challenged for it's validity and enforceability. Obtain professional legal experts to draft your will. In this case, a poison pill clause was inserted as a provision within the will which essentially disinherited a beneficiary who challenged the will. "In Alberta, poison pill clauses such as that contained in the [testator's] will (without deciding the point)... are very arguably contrary to public policy and are at a minimum mean spirited. The validity and enforceability of such a provision is a significant matter of interpretation, and in my view fits within the first exception to the modern rule of costs in estate litigation: interpretation of the will. I have already ruled that it was appropriate that the Applicants seek advice or directions in Alberta. The interpretation of this provision is within the scope of public interest in the administration of estates and is a significant factor in assessing costs." Family Law Minute: What do the courts say about Covid-19 and denying parenting? A parent who refuses to communicate reasonably and in good faith and to quickly demonstrate full compliance with all required COVID-19 rules and procedures runs a real risk of having his or her access or parenting time reduced to virtual time, with the other parent having primary care during the pandemic. The health and safety of the children is the primary concern. Citation: SAS v LMS, 2020 ABQB 287

So many people neglect filing an injury claim because their injury was not so bad. If you were injured and you went to your physiotherapy appointments, this took time and energy from your schedule. Did you know most injuries settle outside of court? Call us today! Don’t wait until it is too late as you may pass your two year limitation period which applies to most motor vehicle claims. Serving Alberta residents.
