STAY INFORMED The Attorney General has caused the Lieutenant Governor in Council to amend O. Reg. 73/20 made under s. 7.1 of the Emergency Management and Civil Protection Act (EMCPC), suspending limitation and procedural time periods as follows: "First, one of the amendments is intended to enhance certainty as to the duration of the order by ‘decoupling’ the order from the state of emergency. Considering the uncertainty as to the nature and duration of the emergency, it is no... longer appropriate for the duration of the order to be so closely tied to the duration of the emergency declaration. Going forward, the duration of the order will be based on all relevant factors and not just the state of emergency" "Second, in light of the concerns raised during my consultations, the suspension of limitation and procedural time periods will now continue up to and including September 11, 2020 (the maximum renewal period allowed for under the EMCPA)." The OPA is very pleased with today's announcement from the Attorney General for Ontario (AG), aimed at building a stronger justice system. At the OPA we've been working very effectively with the AG and with the Law Society of Ontario (LSO) to improve access to justice - and we’ve seen the needle really begin to move. We're especially pleased with the changes proposed today to both the Notaries Act and the Commissioners for Taking Affidavits Act. These two changes will make ...it easier for paralegals to fully serve their customers in their daily practice. Today's changes follow on the heels of the October 23 announcement, increasing the claim limit for Small Claims Court to make it faster, easier and more affordable for people and businesses to resolve their small claim matters. This will allow paralegals to represent customers for claims of up to $35,000. A third area of change is pending - a proposal that will allow paralegals to play an important role in ensuring that family law litigants have access to justice. Together these changes make practical advances in access to justice for Ontarians. And this afternoon the OPA was contacted by Ontario Legal Aid (OLA). Today's announcement by the AG includes proposed amendments to "...give Legal Aid Ontario the tools it needs to help clients resolve their legal issues faster and with fewer road blocks". OLA and OPA hope to sit down together in the near future to discuss the place for paralegals in the renewed and revised legal aid system. Together we are busy moving the needle on access to justice for the people of Ontario. I appeal to every paralegal out there to join the OPA to together we can continue to move the pendulum. A Toronto landlord has been fined a total of $135,000 for renoviction violations at 795 College, a low-rise eight-unit apartment building formerly rented by artists. The landlord plead guilty to three counts of failing to afford the tenant the right of first refusal, a fine totalling $48,000.
