SELLING THE HOME OF OUR AGING PARENTS - Legal Implications. (Part 3 of 3) The final post for this subject matter will discuss the legalities of selling your parents home. It should be said that if the elderly are of sound mind to sign a contract then they should as this makes things easier.... LET'S START WITH THE FOLLOWING: - a will is essential. - retrieve all documents pertaining to the immovable, I would provide you with a list as to what would be needed. - any renovation bills of value to declare on the listing. - if you have already acquired a power of attorney for basic day to day paying of bills and giving you signing privileges, great but you CANNOT legally sign a Brokerage Contract to sell the house. Ask me why.. - Do you sell WITH OR WITHOUT LEGAL WARRANTY? MY OBLIGATIONS as the Broker is that when it comes down to the elderly, I would be present for every visit.
