Pandemic results in REAL Change for Legal Process Today the Saskatchewan Government made permanent the regulations that were first brought in during the pandemic that allowed for electronic (video conferencing) signing of certain documents. Land titles documents, Wills and Powers of Attorney. This is a real and lasting positive change in the law. It gives access to lawyers for people that could not travel or otherwise need to be socially distant. Yes, technology still req...uired at both ends (lawyer and client) to get the video link but for many people that is now relatively easy. Many people have had exposure to video conferencing or meetings and are far more comfortable to say hello in that manner. Proud to be a lawyer in Saskatchewan able to TRULY SERVE people ALL OVER Saskatchewan and elsewhere for their legal needs in specific areas of law. Well Done Saskatchewan government.
Vicarious Liability - Archdiocese of St. John's liable for Christian Brothers actions at Mount Cashel. The Plaintiff's case was successfully argued by my former law professor Eugene Meehan. On July 28, 2020 the Supreme Court of Canada released its decision that upheld the Appeal Court decision. The Archdiocese had argued successfully at trial that it was not an employer of the Christian Brothers who had committed egregious acts of abuse against the plaintiffs who were minors... in the care of the Christian Brothers at Mount Cashel. The trial decision was ultimately overturned by both the appeal court and the Supreme Court of Canada. The Supreme Court noted that that Archdiocese had invited the Christian Brothers from Ireland to staff orphanages, teach at Roman Catholic Schools and paid travel expenses. Strictly speaking the Archdiocese was not the employer, but its role was akin to the master/servant relationship. The Court stated: "The Archdiocese cannot divest itself of civil responsibility for an institution it established, staffed with Brothers to whom it entrusted the care of its residents, and continued to be involved with, on the basis that it did not set the internal governance rules respecting the Order of Christian Brothers." The pragmatic decision serves the ends of justice that the financial ability to pay for damages is put at the feet of an institution that had money - the other defendants being bankrupt.
