COVID-19 - traffic court Further to my previous post, please also be aware that you can pay traffic fines online; there is no need to attend at the courthouse to do so (if you don't wish to dispute your ticket). https://eservices.alberta.ca/fine-payments.html... As always, however, you may wish to receive advice from an experienced lawyer before deciding whether or not to dispute a ticket. Often, a lawyer can obtain a result on your file that you may not have known about or been equipped to achieve. I offer free consultations for all traffic and criminal files.

COVID-19 Court Closures Please be advised that all persons who have a criminal court appearance in Alberta between now and May 22, 2020 will have their files adjourned a period of approximately 10 weeks. The public is encouraged to contact their local courthouses to get confirmation of the new dates; my recommendation is to give it a week or so to allow the staff to have sufficient time to handle the file volume. I also invite any Albertans with court appearances before Ma...y 22, 2020 (who don't already have their own lawyer) to contact me directly instead of the Courthouses and I will follow up with confirming dates. My hope is to relieve some pressure on a very burdened workforce at this time. I'll also be able to walk you through your file and provide options for your matter. There will be no charge for this service and consultation. Finally, for all Albertans with traffic court appearances between now and May 22, 2020, your matter will not proceed in court, BUT, if you have a "first appearance" part 3 violation ticket within this time period, you must still send in your plea of 'not guilty by mail' or you will be automatically convicted of the offence. It's therefore important to follow the instructions on the back of your ticket if you want to dispute it. This page is not a political page. But I'm a lawyer, often possessed of passionate ideals about the role of lawyers and the rule of law in society. What we're witnessing with President Trump and his most-recent Executive Order, known colloquially as the #MuslimBan , is nothing short of a travesty in a Western democracy that prides itself on welcoming all newcomers to a better land. Inscribed on the Statue of Liberty is the following message (in part): With silent lips. Give... me your tired, your poor, Your huddled masses yearning to breathe free, The wretched refuse of your teeming shore. Send these, the homeless, tempest-tossed to me, I lift my lamp beside the golden door! If only President Trump would harken to that call! But, while the despicable nature of the EO cannot be overstated, there are signs that the legal profession and the rule of law are strong. First came the news of lawyers converging at airports across the US en masse to offer legal assistance to those caught up in the ban and who brought legal action against the EO. Then followed Court Orders in several states which invalidated the ban, in parts. Most notably to me, however, is the courageous and principled stand taken by the Acting Attorney General of the United States Department of Justice, Sally Yates, who ordered the department's lawyers to not defend the EO in court. Bravo to this lady who, no doubt remembering her oath as a lawyer, had the strength to do what was right (not just what was in her self interest). She'll no-doubt lose her position - and fast - but she reminds us all to stand against the illegal and unjust actions of the state. Tonight I reflect upon my own barrister's oath and simply hope, if ever were I faced with the decision she had to confront, that I could be as bold as she. http://www.politico.com//trump-immigration-executive-order

The public wants and expects police to apprehend criminals and the "system" to hold them accountable. Governments (and the tax paying public) need to acknowledge the cost of doing so. Alberta has grown significantly in the last 10 years but our number of judges (Provincial Court and federal Court of Queen's Bench) as well as the number of Provincial and Federal Prosecutors is significantly lower than it should be. Both the provincial and federal governments need to adequately fund the system and are currently failing. Add to this the issue of "access to justice" and insufficient legal aid funding (both federally and provincially) and you have a system on the verge of collapse. http://www.cbc.ca//crown-prosecutors-alberta-workload-1.35

Let me digress from the law for a moment to discuss the fallacy of the "extra hour of sleep" that daylight savings time brings us each fall: at least for those of us lucky enough to be parents. First, your Saturday is like any other. You spend the day making up for lost time with the kids during the week. By 9:00 PM, after bath time and stories, you fall exhausted onto the couch for an hour of mindless television to unwind from the day before you stumble -- bleary-eyed -- t...o bed. You wake up at the same (actual) time: too early for any right-minded person on a Sunday. Except, instead of it being, say, 6:30 AM, the "keepers of the clock" magically decree it to be 5:30 AM. Yes, that's 5:30 AM -- as in -- in the freaking morning! But the little ones think it's 6:30 and their tummies want "breathix" (or some other variation of the morning meal) so you stumble into the kitchen to prepare. However, your body is conditioned, after 6 months of existence since the last time change, to barely make it to 9:00 PM before you fall exhausted, once again, to the couch. Except that it's only 9:00 PM in your head; on the clock is an insistent, insulting, "8:00". Time for bath and snack and teeth and stories. How, pray tell, does anyone say (with a straight face) that we got an extra hour of sleep?

"Freemen". "De-Taxers". "Sovereign Citizens". All of these terms (and more) are used to describe similar movements popping up all over the world, including right here at home. Most recently, in the Camrose Booster "Letters to the Editor" (April 28, 2015). Allow me to be very clear: these movements / ideologies are fraudulent, ridiculous scams. People who subscribe to these ideas inevitably find themselves at odds with mainstream society and will, often, ruin themselves and ...their families in the process. Why this post? Well, to anyone on the tipping point, I aim to bring you back from the ledge. In the law, these movements are a great drain on our system and I'd be remiss to not try and combat that waste. An impaired driving conviction will have serious consequences for you beyond the sentence you receive in court. First, you'll have a criminal record which can greatly impact your ability to travel outside Canada. Many popular destinations, including the United States and Mexico, may refuse you entry with any criminal record. Second, your auto-insurance rates will increase, and remain higher than usual (in most cases), from 3-6 years. This can add many thousands of dolla...rs to the financial impact of impaired driving over those years. Finally, your licence is not only suspended; there are several requirements for you to obtain, once again, a valid licence (following a conviction). the Court will prohibit you from driving for a minimum of 1 year; the Alberta government will require you to enter the alcohol ignition interlock program for a minimum of 1 year following your absolute prohibition period (with a monthly rental fee on the device), & there is a reinstatement fee to be paid as well. All totalled, this adds at least $2,000 to your cost. If you're charged with an impaired driving offence, you need to be informed of your options.
