Ask not what a lawyer’s success rate is. Some clients tell me that another lawyer told them of their 80% success rate. I chuckle and tell them 20% of his clients may be disappointed. ... It’s not possible for lawyers to predict a success rate because it’s impossible to control an outcome of a file: - is your evidence weak? - maybe you’re a terrible witness? - maybe the stress will get the best of you? Success in professional services is not measured in percent but lies in creative strategies that constantly evolve.

A lawyer, his expert and witness go on a road trip. Early in my career a client asked me to takeover his lawsuit, 12 hours north in the Gaspé. I said hell yes and found myself driving in his minivan along with my expert witness and client’s mom. ... Way up north by the peninsula, I slept at my client’s parents home for the next week. Preparing for trial, I was exposed to an incredible culture of hospitality that I wasn’t expecting. Every morning before trial I had breakfast with the family to home made biscuits and fresh eggs from their farm. In the evenings, reviewing trial notes and strategies, I would have a beautiful home-cooked meal and sample beer from the local microbrewery. Exhausted at the end of trial, I still had a little energy for sightseeing like Percé’s Rock. Relieved and on the way home, we laughed about the mishaps and crazy trial stories. To this day it is one of my fondest memories as a lawyer. These experiences can’t happen if you’re closed-minded and say no to clients and opportunities. Say YES to opportunities until a road trip changes the course of your career.

This interview question helped me choose my candidate. I interviewed people for a job this week and after 30 seconds of small talk, I hurriedly asked one question: "Would you be stressed if I hired you now and sent you to court tomorrow morning?"... She smiled and answered: "Yes I would be nervous, but I would prepare all night and do my best tomorrow." I was hooked on the go-getter attitude and felt her hunger to do what it takes for the firm. I don't have an HR degree, but experience confirms to me over and over that you should always: Hire for attitude, train for skill.

Market rates for lawyers follow trends based on experience, results, accolades and other arbitrary factors:... - I've worked in files where results are so spectacular that my effective rate is 5 figures. - other times the process is so inefficient that I work for less than minimum wage. - Sometimes I work for free as a commitment to communities or clients in need. - Other times I worked on % and didn’t make a dime. If I am worth the sum total of my professional and life experiences, are you likely to find me more valuable If I charge $1,000 rather than $300? I’ve committed the last decade of my life trying to bring you value, and time is the most valuable thing we can spend, no matter than rate.
