Control your donkeys/mules/animals! Property owner at fault for loose donkeys on the road: Ontario court finds that it was negligent for a property owner to have failed to carry out regular inspections and notice that the gate immediately adjacent to a roadway was unlocked. The trial judge found that the donkeys (or mules - they use both terms - I'm not sure any of the people involved knew anything about equids!) pushed through a gate to escape onto the road. The property o...wner appealed this decision because they felt their tenant (who owned the donkeys) should have been liable. The Court of Appeal disagreed, saying that the property owner had a duty to secure the structural integrity of the fence. The Supreme Court of Canada refused leave to appeal this decision. Bottom line: check your fences regularly, keep your livestock and motorists safe, and get 3rd party liability insurance with respect to your animals. Youssef v. Misselbrook, 2020 ONCA 83 (CanLII),
