In May of 2013, 17 year-old Rowan Stringer died after suffering multiple concussions while playing rugby for her high school team in Ottawa. Sadly, a lack of kn...owledge surrounding treatment and protocols for concussions (especially repeat concussions) may have contributed to her death. The coroners investigation which followed resulted in a total of 49 recommendations to prevent similar tragedies from occurring ever again. The first recommendation from the coroners investigation was that Ontario enact legislation to recognize the importance of education and protocols surrounding concussions suffered by young people while playing sports. On March 6, 2018, Rowans Law was enacted by the Ontario Legislature. Rowans Law imposes various requirements on sports organizations regarding concussion education and procedures for removing children from participation following head injuries. Rowans Law requires that children review and understand a concussion awareness resource before they participate in sports. In other words, Rowans Law seeks to increase awareness surrounding concussion among those for whom it matters most: children in sports. Rowans Law also imposes on sports organizations a requirement to establish protocols for both removal from sport and return to sport for athletes who are suspected of having sustained a concussion. Rowans Law should bring greater awareness to the significance of concussion injuries in sports, and avoid second impact injuries, like the one that killed Rowan Stringer. Few of us think twice about lending our cars to family or friends. We tend not to consider the possibility that an accident could occur when someone else is dri...ving our car. Provided the borrower is licensed and legally allowed to drive where the car is insured, there is nothing in our insurance contract that requires us to name the borrower on our insurance policy. This changes if the borrower is using the car on a regular basis. For example, a family member or friend who borrows the car to drive their children to a weekly hockey practice should be named as an occasional driver. An owner of a car owes a duty to make sure that it is operated safely regardless of who is behind the wheel. This duty is codified at section 192(2) of the Highway Traffic Act. An owner of a car is liable for any loss or damage caused to any person by reason of the negligent operation of their vehicle. This means that if you lend your car to someone who rear-ends another car and causes the occupants of either car to suffer serious injuries, you will be named as a defendant in a lawsuit for damages. However, if the car was stolen or otherwise being operated without the owners consent, there is no liability on the owner. Ensuring that our cars are adequately insured is the best way to achieve peace of mind when lending (or driving) a vehicle. It is surprising how many car owners still have insurance policies that provide only $1 million in liability protection when it costs only a few dollars more to increase our limits to $2 million. A car owner with only a $1 million insurance policy risks personal exposure to having his or her assets seized if their car causes an accident resulting in serious injury. When you lend your car you are also lending your insurance. For this reason it is important to make sure you are adequately protected before you lend your car to your family or friends.

Sometimes fault in a motor vehicle accident is clear. A distracted driver speeds through a stop sign and hits an innocent driver who had the right of way and no... time to react. The distracted driver is 100% at fault. The innocent driver is entitled to sue the at fault driver and recover all of his or her damages/losses from the distracted drivers insurer. Sometimes, both drivers are at fault. A driver makes a left hand turn on a yellow light into the path of a vehicle that was driving 20 km per hour over the speed limit. The left turning driver is at fault for making an unsafe turn. The through driver is negligent for speeding. In a situation like this fault is divided between the parties on the basis of who the judge or jury thinks more blameworthy. It can be divided 75-25, 50-50 or by any other allocation. If the speeding driver is found to be 25% at fault, he is only entitled to recover 75% of his damages against the insurer for the left turning vehicle. In some cases, a driver who may initially seem innocent can be found to be at fault. Two cars approach each other on a two lane road. One of the cars drifts over the centerline causing a head-on collision. While the driver of the car that was hit might seem like an innocent victim, our law will examine whether he or she could have taken reasonable steps to avoid the collision. If the otherwise innocent driver failed to take reasonable evasive steps, he or she may be found to be at fault to a minor degree. The best time to gather the evidence about who is at fault is in the early days following an accident when skid marks and damaged vehicles are still available for inspection.
