As of January 1st 2020, the Small Claims Court monetary jurisdiction will increase from $25,000 to a maximum of $35,000. This change by the Ministry of Attorney General of Ontario is a great step forward for access to justice. The minimum amount of a claim that may be appealed to Divisional Court will also increase from $2,500 to $3,500. Litigants who started a claim in the Superior Court will be permitted to transfer their case to Small Claims Court if the claim falls within the monetary threshold. These changes will cut down wait times in courtrooms, and give parties more cost efficient representation options such as paralegals.

Recently, advocating for individuals has now evolved into advocacy on behalf of the residents of Ontario while challenging the constitutionality of a law that imposes additional fees after conviction for an offence prosecuted under the Provincial Offences Act. Specifically, after a recent Supreme Court ruling (Boudreault) that declared victim surcharges in criminal prosecutions unc...onstitutional, a challenge was brought by this office to determine the constitutionality of a similar victim surcharge provision in relation to provincial offences (e.g. traffic/insurance offences, liquor offences, employment and labour offences, college of trade offences, environmental offences and by-laws). A decision will be rendered in March based on the materials filed; updates will follow as available. Know your rights, enforce them with a paralegal.
