"The Union’s Application had two components. First, it alleged that Uber and Lyft committed unfair labour practices and violated Sections 6(1) and 6(3)(c) of the Labour Relations Code, RSBC 1996 (Code) through their Terms of Service, which purportedly discouraged drivers from signing union cards. Second, the Union applied to have the Board declare, pursuant to Section 139(a) of the Code, that drivers are employees under the Code. In every lawyer’s career there comes a case or moment that offers a remarkable experience; it may be a small observation or an incident that offers an opportunity to gain a deeper understanding of the law or of one’s self. In this ‘Memorable Case’, Kornfeld Partner Lana K. L. Li reflects on a dispute that began 25 years ago and one that she often tells as a mentor. Lana maintains a broad commercial litigation practice, with emphasis on commercial landlord/tenant disputes. But... she also works on select family law disputes, and it is one of her first cases that she recalls: I was involved in a very contentious family law dispute. The client, a mom, was living in the United States, and her children were here in Canada visiting their father. For various reasons, the father made it known to border patrol that the kids weren't permitted to live in the U.S., where they had been living with both parents before the separation. As a result of this, the children were not allowed to return to their mom in the U.S. So, I obtained a court order which basically allowed the mother to come and take the children back. I remember she had to fly to Canada, and I remember meeting her at the hotel where the kids were staying, and we went upstairs to the room. Her kids ran up to her and hugged her, they were so happy to see their mom. And I remember her face, the expression of relief on it when she was reunited with them. That was unforgettable. It made me feel like I had done something to benefit this family. The law is interesting, but here was the law working in real life. We reconnected a mother with her children. This incident was really just the start of a very long, hotly disputed case, and I met these kids on and off through the process. Years later, one of the children actually went to law school to become a lawyer. I was told that the child’s experience during the dispute and my role in it were part of the reasons for wanting to be a lawyer. It’s something I think about. Another interesting outcome: years later, someone adverse to us from that family law dispute wanted to retain me. I said no, but the fact that this person remembered my work and wanted to retain my services, I take that as a compliment.

Sept 22 marks the early launch of the Supreme Court of Canada's fall session - to allow time to hear all cases previously postponed due to COVID-19. Measures will be put in place in the courtroom to meet physical distancing requirements, and hearings will also take place via videoconference when needed.
