Lagoon City Shorewalls 05.03.2021

LC owners are asking how to respond to multiple letters Ramara Township is mailing asking for plans to repair or replace shorewalls following shorewall inspections in 2016 and 2020. In a January 27, 2020 Deputation, Council was told that the proposed new shorewall bylaw had deficiencies in respect of economics, engineering and more importantly that the propsed bylaw was illegal and if passed that it would be challenged and be defeated in Court. Despite that information, the ...bylaw was hurried to a vote & jammed through in a shameless example of political chicanery with only 3 votes from Joe Gough Kal Johnson Basil Clarke. No other members of Ramara Council voted in favour of passing this illegal bylaw. Last week Loopstra Nixon LLP, lawyers for the Lagoon City Phase One Group filed an application in Ontario Superior Court to quash bylaw 2020.16. Three years ago, Ramara Township following the instructions of LCPWC, mailed about 50 invoices to property owners in Phase One. The invoices totaling more $18,000. were sent under false pretenses because they were not authorized by a municipal fee bylaw. Subsequently unpaid fees were added to owner’s tax accounts bearing 15% interest. This is about LCPWC Phase 1 shorewall inspections. TWO YEARS after giving 4 Lagoon City seniors TWO WEEKS to reply to Formal Notices delivered by registered mail, Ramara Township STILL has not handed down the decision the LCPWC Chairman promised to deliver by April 13, 2019! Threatened with enforcement, these property owners spent thousands from their retirement incomes for engineering and legal representation at the LCPWC's Hearing. They played by the rules. (Bylaw 2017.25 & Ontario's Bill Pr 11 The Township of Mara Act) What's wrong with our Township? Why must taxpayers comply with bylaws while Ramara Township violates bylaws and then adopts new bylaws? The Township FINALLY identified 9 other Phases which includes all of Lagoon City. Phase 2-10 owners, could you meet the cost of bylaw 2020.16?

The Phase One Group's crusade to have the Township allow ENGINEERED, ECONOMICAL and ENVIRONMENTAL shorewalls constructed in Lagoon City continues. The LCPWC’s inability to follow through with an enforcement action on four Lagoon City property owners resulted in the Township removing the shorewall maintenance enforcement from the LCPWC. Happily, the Township's Infrastructure Department is implementing a long term plan involving the inspection of ALL Lagoon City shorewalls. REFUNDS of ALL Phase One shorewall inspection fees collected without legal authorization - DONE! On October 8, 2020 the LCPWC voted to refund Phase One Inspection Fees 2. PERMITS for three shorewall applications submitted November 2018, and four submitted October 2019. All seven complied with Bylaw 2017.25. and had secured Lake Simcoe Regional Conservation Authority (LSRCA) permits at a cost of $300 each - PENDING TWO YEARS later we are STILL waiting for permits 3. REIMBURSEMENT of legal fees and compensation for damages for the four subjects of the LCPWC Enforcement Hearing. The LCPWC enforcement action cost these four subjects more than $25,000 and the LC Phase One Group more than $20,000 Ramara’s lawyers and Integrity Commissioners are 0 for 2 against the Phase 1 Group's lawyers. Since 2018, Ramara Council fired the Township’s lawyers and the Townships Integrity Commissioners. More of your taxes may be wasted on legal fees? BREAKING NEWS: October 19, 2020: Ramara’s Committee of the Whole (COW) Agenda Sec 4.1: Staff report WD-22-2020 Lagoon City Shorewall Inspection Status Report is a timeline for the inspection and repair of ALL Lagoon City Shorewalls. see rebrand.ly/phases Sept 28, 2020: 70 properties in Phase Two ( pink and teal on Staff Report map ) were sent letters advising them that the Township's Chief Building Officer would be visiting their property to inspect their shorewall.... Phase Two owners and owners from other Phases are invited to join the LC Phase One Group for access to an ENGINEERED, ECONOMIC and ENVIRONMENTALLY FRIENDLY shorewall design. If inspection indicates your shorewall needs repair or replacement join the Phase one Group and participate in the Group’s benefits; an engineer designed affordable, environmentally friendly shore wall based on soils engineering a shorewall design that the LSRCA likes and has granted permits for a marine contractor who works from a barge causing less yard disruption group pricing that members can share The Phase One crusade for well ENGINEERED, ECONOMIC and ENVIRONMENTALLY FRIENDLY shore walls is moving forward. The Phase One Group needs additional financial resources to bring the quest for affordable shorewalls for all of Lagoon City to a successful conclusion. Invoices from lawyers and engineers must be paid. REMEMBER, the Phase One Inspection Fees for more than 50 properties are being refunded because of the investment and commitment of the 20 members of the Phase One Group. On October 8, in an unprecedented climb down the Lagoon City Parks & Waterways Commission (LCPWC) passed a resolution to refund $20,000 of illegally invoiced Phase One Shorewall Inspection Fees to Lagoon City property owners. This ONLY happened because the 20 member LC Phase One Group financed more than $20,000 of research and legal fees to make this happen. Ramara Township owns more than 1,000 meters of shorewalls. ... Ramara taxpayers here’s an update from the LC Phase One Group who maintain that the repair and reconstruction of our shorewalls should be ENGINEERED, ECONOMICAL and ENVIRONMENTAL friendly for more detail see rebrand.ly/shorewallbriefingbook A March 2019, marine contractor’s estimate for a 25 meter shorewall complete replacement using synthetic sheet piling with a concrete appearance is $47,663 (HST included) Synthetic Sheet Piling Cost / Meter $1,900 The November 2018, LCPWC and Tatham Engineers enforcement estimate for the same 25 meters of shorewall using steel sheet piling with concrete cap and face is $98,250 + HST. The difference is $50,586 + HST Steel Sheet Piling with Concrete Cap and Fascia $3,150 / Meter + HST Ramara taxpayers will be paying for the Township’s construction of 25 meters of shorewalls for the Lake Avenue Weed Off-loading Ramp at an estimated cost of $3,150 / meter for a total of $78,120. July 2019, the Township’s engineers, Tatham Engineers, included costs of site preparation and restoration bringing the complete shorewall construction cost to $103,680 The Phase 1 Group needs your help and your financial resources to bring our quest for affordable shorewalls for all of Lagoon City to a successful conclusion. Invoices from our lawyers and engineers must be paid. REMEMBER only because of the investment and commitment of the Phase One Group are YOUR Phase One shorewall inspection fees being REFUNDED.
