Open Houses Permitted! Effective August 12, 2020 municipalities in the Windsor-Essex County Health Unit region entered Stage 3. The prohibition on open houses h...as been lifted. Two forklift drivers convicted under OHSA for using cellphones while engaged in the operation (including stationary operation) of forklift. "...the circumstance of a worker operating equipment in a manner that may endanger himself or another worker under s. 28(2)(b) should be interpreted broadly to include a worker using a cellphone while standing beside a turned-off stationary forklift or while sitting on a turned-off stationary forklift in a work area where there are the pr...esence of other workers and workers using equipment or machines." -- Quon J.P. This is a work refusal case and not related to an accident or injury. A third driver refused to work while other forklift operators were engaged in the use of cellphones on the plant floor. A Brampton couple were in breach of contract and will be required to pay damages resulting from a broken real estate deal, after backing out of an unconditional agreement in the face of a dramatic drop in the market. Ontario Superior Court Justice Paul Sweeny wrote in his judgment, "A drop in real estate values, even a dramatic drop, would not meet the test of frustration, impossibility or be a force majeure." In Beatty v. Wei, the parties entered into an agreement of purchase and sale (APS) in May 2016 for a residential property in Toronto. The purchase price was $916,000 and was secured by a $30,000 deposit. The APS contained a standard representation and warranty concerning illegal substances. The Court of Appeal for Ontario recently rejected the home buyer’s attempt to rescind the real estate deal on the grounds that the house in question had previously been used as a marijuana grow-op. Getting employment contract language correct is tremendously important, especially the termination provisions. Courts are very quick to find problems with employment agreements that restrict employee rights to notice of termination.
