The new law is likely something that won't pass constitutional muster. Police can't just go at random and asking people what they are doing. They could do this, however, if they have reasonable grounds that an offence is being committed.
Very important to landlords seeking tenants or in the process of screening them. What you can ask and what you cannot ask for.
Some thoughts, as we see Ford put yet another stay-at-home order on in Ontario tomorrow https://www.facetsjournal.com//fu/10.1139/facets-2020-0070
https://www.ctvnews.ca//supreme-court-of-canada-set-to-hel This is an interesting decision that I am following, because how many times did I have to crawl over a snow bank, only to fall flat on my face at the other side, because nobody leaves a clearing to get onto the sidewalk? This is just another way that cities are built for cars, and not for people.

Ontario announced a lockdown for 28 days, starting Boxing Day. I will still be available at the office after my holiday break but, will hesitate to accept anybody for in office appointments, at least until we are certain as to what our best public health advice is to protect the office staff, clients and vendors. Payments can be made by e-transfer, credit card (by giving us the number and we put it in), or if none of that is possible, by dropping off cash or cheque (with m...ask and full gear but not staying). Most courts and tribunals are not having in person hearings for the foreseeable future, so many of these things will only be accessed by phone or computer (video-conference). I am working hard. I created a complaint to the Tribunals Ontario to find alternatives for people without computer or difficulties using the phone. We are still accepting new cases for LTB, small claims, human rights, whatever, and we can file and receive defenses, or file defenses, and certain types of motions. I also intend to file reviews or other types of 'appeals' where by reason of technology, by disability, or other related reason that anybody was unable to fully participate in a hearing because of the way the hearings are being held.
This is creating a major conundrum in the employment law community, forcing us to accept one of the less effective pillars of justice in holding an employer accountable.
Canada is very ableist ... federal benefits and their eligibility criteria views disability from an able-bodied perspective.
This is heading off where there may well be a challenge as to how people on income assistance, particularly for disabilities, when the federal government determines INDIVIDUALS need at least $2,000 to live on, while people with disabilities live on about half that. How is that fair and logical? Our province should be ashamed!

Have had some of these virtual and phone hearings ... still some things need to be done in person. With less onerous hearings and motions virtually.
This is a particularly alarming message. People with disabilities were terribly disadvantaged over the course of the pandemic.
A Vancouver Island wheelchair user who has spent years asking her strata for changes to make it possible to go to and from her condo safely and without help ...from friends has won $35,000 in damages and an order for action on her complaints. Last week, the B.C. Human Rights Tribunal ordered the owners at the Eagle Point Bayview complex in Nanaimo to begin the process of making their building wheelchair accessible, and to pay a penalty to 76-year-old Ada Jacobsen for injury to her dignity, feelings and selfrespect.
Another landlord practising self help tactics
Imagine if this happened in Ontario
The Ontario Paralegal Association is speaking out about the inefficiencies, slowness, molasses-in-January approach and dog's breakfast of a Landlord and Tenant Board. These issues have already gone to the Ombudsman Ontario office, as well as various other avenues. Keep reaching out folks. Add YOUR voice to this important issue.
Former Adjudicator Petar Guzina writes a blog. I appeared before this man many times and find him to be very knowledgeable in this area. This is a commentary on what to expect in landlord and tenant matters already filed but not scheduled, or for new matters about to be filed.
Legal firms have suffered major losses during the pandemic. Factors such as court and tribunal closures, as well as less people able to afford legal fees, is mentioned. Yet, we still have to pay full dues, full insurance, full everything else. Interesting.
Our practice is fully operational to the public at this time. Clients can meet virtually through ZOOM, telephone and Internet/email; or they can come to the office where masks and hand sanitizers are mandatory, with exceptions allowed by law. Social distancing at six feet is also maintained at all times. Feel free to contact us about your legal issues today!
