Separations and divorces are seasonal. The trend is to go down between Thanksgiving and New Years and bounce back again in January. The thinking is that the h...olidays are a bad time to separate, making it harder on loved ones and children. Well, the wait is over and if there was wishful thinking for things to improve, proven wrong, then folks may be back to the drawing board contemplating leaving. However, there also remains the option of counseling. The thing about counseling when the relationship is on the ropes is that if you still decide to separate, maybe you can be helped to do so more peacefully. Either way, please look at choosing therapists and lawyers familiar and supportive of mediation and Collaborative Family Law. Even of one side chooses to run to court, your acting in a peaceful manner looks better and can be influential in the eyes of the court. And do not believe peaceful to mean rolling over for something unacceptable. It only means you don't have to get into the mudslinging to still hold your ground. So, here we are in a month where people will return to reflecting upon their relationships. Still, go slow with both eyes open and rely on advice that seriously considers the needs and interests of both persons and children. It can be tough and it can always be tougher too. That in part depends on you.

Domestic violence is real, it happens in many families where you suspect it and in many where there are very few signs, the behaviour happens sporadically or it is just starting. False accusations of domestic violence are also real, used by former partners to provide a narrative for the breakup, to obtain full or sole custody of the children, and sometimes to alienate the kids from a parent or a side of the family. In either case, many of both the real and the fake case...s land in both criminal and family courts. What agencies and courts MUST do is listen and watch. Each person’s credibility must be tested and emergency, provisional, interim and final arrangements for the right parenting for the child(ren) to be put in place. Abusers can be very good at covering up their behaviour and convincing others they are not abusive. Some people have in fact assaulted their spouse before and with therapy, insight and behavioural modification, they can choose to not use abuse as an option. Some people are accused of abuse in furtherance of a mission by the other parent to have custody of the children and exclude the accused parent. In our practice, we have seen the evidence of both types of cases. You should not be threatened with losing your children if you truthfully disclose that your spouse has been abusive. But it may very well have an impact on custody and parenting going forward in cases where one parent falsely accuses the other. It takes wise, experienced and perceptive people to correctly assess each case.
