Quite often I receive enquiries about obtaining work permits from people who are currently outside Canada. I am not suggesting that obtaining a work permit is impossible, however I am prepared to say that in many (not all) cases, it is very unlikely that the application will be successful. In most cases the prospective employer will require a Labour Market Impact Assessment (LMIA) from the government in order to support the work permit application. The LMIA is essentially ...a process wherein the employer has to demonstrate that they can find no Canadian worker qualified for the job or who wants that job and hence they have no other option but to hire a foreigner. This process involves the employer advertising the position, interviewing people and they also have to pay non refundable processing fees as well. Again, I am not saying it is impossible, but it is highly unlikely that an LMIA application will be successful unless the position is highly skilled and there is a shortage of people to fill the position. No LMIA means no work permit. Express entry seems great on the face of it, however like many people outside the country who have no Canadian work experience, you will likely find yourself just like thousands of other people who do not have enough points to warrant an Invitation to Apply (ITA) for PR, sitting and hoping you get an ITA. I have made the decision not to accept any express entry cases for people outside of Canada, I can’t morally justify charging someone to simply set up an express entry profile and hope they get an ITA. If it is unlikely that I will perform any immigration services I don’t see the point. Another option many people outside of Canada opt for is a study permit. They come to Canada as students, and they get a work permit that is attached to the study permit. After graduation they can apply for a post graduate work permit (PGWP) and it is the work experience gained while working on that PGWP that counts toward the various programs available to apply for PR. I have been recently retained by people who are either in Canada on a study or work permit or they wish to come to Canada as a student. The idea is to get a Canadian credential, eligible work experience and then apply for PR via the Canadian Experience Class. Many of these cases have a few things in common which have prompted me to provide the following advice:... 1. Misrepresentation aka lying to the Federal Government of Canada is NOT an option. 2. If your representative is willing to assist, aid, suggest or facilitate your lying to the government then you have bigger problems than you ever concieved. 3. Start the process with your end goal (landed status in Canada) in mind and retain a representative who is prepared to assess your situation and provide honest and ethical advice BEFORE a discussion about fees takes place. The quality of your representation will partially influence your chances of success and and remember no representative can GUARANTEE success .
