NDP MPP Wayne Gates introduced a Private Member's Bill, Bill 191, Workplace Safety and Insurance Amendment Act (Presumption Respecting COVID-19), 2020, which has made it through first reading. The Bill, if passed, would create a new section (s. 15.0.1) of the Workplace Safety and Insurance Act, 1997, that would provide presumptive WSIB coverage to any worker who worked for a business that was listed as an essential business in an order made under the Emergency Management and Civil Protection Act, and received a positive test for COVID-19 on or after January 25, 2020, unless the contrary is shown.

On the National Day of Mourning, April 28, Canadians will pay tribute to workers who have died, were injured, or made ill from their work. Especially poignant this year as we honour those frontline workers who sacrificed their health and lives serving the frontline during the pandemic.

As you know, the province has enacted a declaration of emergency to help contain the spread of COVID-19. This has resulted in closures and restrictions that have impacted the way we live and work....Continue reading

The following is a meta-review of what lawyers are saying on-line about an employer’s duty under the OHSA to send a worker with apparent COVID-19 symptoms and a worker’s right to refuse to work with a colleague who is exhibiting such symptoms in the work place. This following is general information, and not intended as legal advice. The IWH reports that among workers reporting cannabis use in 2018, about one in five indicated they used it in the two hours before work, during work or during work breaks. This is one of the findings from an Institute for Work & Health (IWH) cross-Canada survey conducted in June 2018, four months before non-medical cannabis was legalized. An IWH research team is surveying this same group of workers (and more) for three years post-legalization to track how their use of, and beliefs about, cannabis at work are changing. For a snapshot of the findings about pre-legalization consumption habits and attitudes among Canadian workers, take a look at our new infographic.
