One of the most aggravating traffic tickets in Ontario is the offence of "Escape by Flight". Also referred to as "Flight from Police", section 216 subsection 3 of the Ontario Highway Traffic Act (HTA) creates the offence for when an individual willingly attempts to evade a police officer while in pursuit. This section of the HTA gives police the power to execute a traffic stop while simultaneously creating a requirement for a driver to comply and pull their vehicle over when... directed. The respected penalties upon conviction are as follows: a) monetary fine between $5,000 and $10,000; b) five (5) year Ontario Driver's Licence Suspension; and c) the presiding Justice of the Peace SHALL impose a MINIMUM jail sentence of 14 days, or a maximum of 6 months Due to the serious nature and wording of the offence, s. 216(3) Escape by Flight is classified as a "Mens Rea" offence, meaning that the Crown must prove the "mental" element (willingness to evade) which can be difficult.
