McGill Journal of Sustainable Development Law 11.06.2021

Passing along some exciting new from our latest podcast guest, Me Vega Cárdenas, President of the International Observatory of Nature’s Rights: "It is with great pleasure and enthusiasm that the International Observatory of Nature’s Rights (OIDN) officially invites you to the launch of its first book: A Legal Personality for the St. Lawrence River and Other Rivers of the World. The texts in this collective work deal with the implications of granting a legal personality and ...rights to the St. Lawrence River, examine the epistemological foundations of the paradigm of recognition of the Rights of Nature, and present concrete cases of recognition of Rivers as subjects of law. This book answers questions about the implications of such recognition and contributes to the process of building a new law that has just begun in Quebec and Canada with the adoption in February 2021 of resolutions conferring the status of "legal person" to the MagPie/Muteshekau Shipu River." In this episode by Associate Editors Ashley Light, Emily Michelin and Angela Yang, we learn about environmental personhood from a lawyer directly involved in the Magpie River Legal Personhood Project! Me Vega Cárdenas, Professor of Law at the Université de Montréal and President of the International Observatory on the Rights of Nature, tells about the significance of the Magpie River being granted legal personhood: The decision means that the river is no longer an object t...hat we exploit but a person, a subject that we respect it means that the river is alive in law. Provoking a paradigm shift inspired by indigenous juridical traditions, this decisions is a recognition that the Magpie River is no longer the object of protection but a holder of rights. This is the last episode of our first podcast series - we were lucky to have such inspiring guests on each episode and to be able to spotlight such important issues in the area of sustainability law. A huge thank you goes out to our Podcasts Committee for all their hard work!
