One in four Canadians suffers from chronic pain conditions. Chronic pain conditions are also often associated with mental health illness. The combination of chronic pain and clinical depression can be even more disabling than either condition alone. Such conditions can prevent an individual from being able to work and compromise financial well-being. For many people with chronic pain conditions, the COVID-19 pandemic led to reduced access to regular medical care, resulting in... a deteriorating state of mental and physical health. Many people suffering from chronic pain may rely on disability benefits to replace a portion of the lost income. Sadly, insurance claims for subjective conditions like chronic pain are often denied. Read our recent blog to learn why chronic pain disability claims are denied: https://bit.ly/3b4iniM #MentalHealthWeek #GetReal

Mental health conditions can significantly impact an individual's life, relationships, and ability to perform daily functions. Depression and anxiety are among some of the most common causes of disability in the workplace. Despite the prevalence of mental health illness, adequate support and resources are often hard to access. Many insurance companies still lack a complete understanding of these conditions and frequently deny mental health disability claims. Sarando Matheos, a Partner in the Insurance Denial group at McQuarrie, discusses some of the most common reasons why mental health claims are denied. This week we are joining Canadian Mental Health Association in celebrating the 70th annual #MentalHealthWeek. In times of extreme anxiety and stress, it is crucial to recognize how central mental health is to our overall well-being. It is critical that every person has access to the space and resources to express and process their emotions. Find resources and helpful topics on CMHA website: https://bit.ly/2PJdDmw

In the digital era, the lines between personal use of social media and one's professional life can often be blurred. In a recent case, a professional association accused a Saskatchewan nurse of misconduct for posting comments about the care her grandfather received in his final days at a care home on her personal Facebook page. Brad Kielmann discusses the implications of professional scrutiny on the freedom of expression and privacy rights in the most recent issue of Canadian Mortgage Broker Magazine: https://bit.ly/374SfSG

Long term disability insurance is designed to temporarily replace a portion of your income if you become disabled and are unable to work. Most people hope never to use those benefits, but if you are experiencing a situation where you're unable to work because of an illness or an injury, you may discover that accessing your disability insurance is not as easy as you had hoped. Read our latest blog where our insurance denial lawyers discuss the reasons why a long term disability claim may be denied: https://ecs.page.link/4LXau

Mental health disorders are often not considered as debilitating as an illness or injury that can be seen and measured objectively. However, mental illness can significantly impact your ability to perform daily tasks or even job duties. Unfortunately, mental-health-related denials of disability insurance are extremely common because mental illnesses are "invisible" and are more complicated to "prove." Learn why mental health claims are denied and what to do if your disability claim has been rejected in our latest blog. https://ecs.page.link/AYTMW

Invisible disorders such as mental health disorders, chronic pain or fatigue can have notable impact in the case of insurance claim denials. Due to their complexity to prove, insurance claims that are related to these disorders are known to be denied or challenged by insurance companies. If you are facing a denied disability claim that is a result of an invisible disorder, give us a call at the first sign that your insurance company has denied your claim. 604.581.7001 A member of our experienced Insurance Denial team will be happy to help you. https://ecs.page.link/cTzrg

Has your employee's long term disability insurance claim been denied? Did you know that they only have a limited time to sue an insurer and the appeal process does not extend their time to sue? Insurance companies can deny a claim for any number of reasons. But regardless of the claim or reason, insurance denials are discouraging, time-consuming, and often very frustrating to deal with for both employees and employers. Proving the validity of a disability claim can be difficu...lt and insurance companies are increasingly likely to challenge them aggressively. Even if your employee has launched their own appeal, talking to a lawyer who understands the process can make all the difference. Our Disability Lawyers can assist employees with a wide range of insurance matters including long-term disability insurance denials and critical illness insurance denials. Have your employee contact a member of our Disability Claims team if you think they require legal advice. https://ecs.page.link/cTzrg

Co-parenting can be difficult at the best of times. With a pandemic in the mix, the complexity of the situation will only intensify. In the midst of COVID-19, it's important to ensure that you and your ex-partner have a solid co-parenting plan. Here are some tips to establish safe and effective co-parenting strategies: Keep communication lines open, whether they may be phone calls, text messages, or emails. Make sure that you answer your ex-partner in an efficient and timel...y manner to prevent any confusion when it comes to pick-ups, drop-offs, and other intricacies of a successful co-parenting relationship. Even if you are physically distanced, stay socially connected. If it is not in the best interest of your child to go between homes at this time, schedule regular virtual visits via video chat. Remember that everyone is having to adapt and make changes to live safely with this pandemic. Remind your child and your family that this is only temporary and that you will get through it together! When dealing with insurance policies, pre-existing exclusion clauses and other policy terms are often worded in a confusing manner making it very difficult for your employees and their doctors to know what needs to be proven to the insurance company in the case of long-term disability. This is a very good reason to have an experienced disability lawyer review your employee's claim when it is denied for whatever reason. Ellie H. was a 40 year old woman working in Human Res...ources. She was also born with spina-bifida, a condition arising during fetal/child development where the vertebrae don’t form properly around part of the spinal cord. These spinal issues have resulted in life-long chronic pain. Ellie's condition never stopped her from working. Shortly after commencing a new dream job, she became ill with an infection which led to a diagnosis of chronic fatigue that forced Ellie to stop working only a few months into a job she loved. She applied for short term disability benefits and her claim was accepted and paid. However, when it transitioned into long term disability, to her shock, the insurance company denied her claim based on a pre-existing exclusion clause. Learn about how McQuarrie helped Ellie win the benefits she deserved https://ecs.page.link/8tKTn

You may have heard that as part of the response to the COVID-19 pandemic mandatory limitation periods for commencing a civil action, proceeding, claim, or appeal in BC (with some limited exceptions) were ordered suspended. In essence, the government legislated that the clock on limitation periods was to stop ticking for an undefined period of time during the state of emergency. The BC government has now provided advanced notice that although the public health state of emergency continues, the suspension of time will end on March 25, 2021. If you have a claim, but have not commenced an action, don’t wait call McQuarrie!

Divorce is never easy, especially if children are involved. However, it's important for both parents to play an active role in their children's lives post-separation. And although co-parenting may be easier said than done, it's one of the most effective ways to ensure that your children maintain close relationships with both parents. One of the best methods to foster a healthy co-parenting environment is to separate your relationship with your spouse from the co-parenting rel...ationship itself. This will allow both parties to overlook any relationship issues that may be present and put the needs of their children first. Co-parenting is beneficial for children in a number of ways: It provides consistency and emotional security It gives children a healthy and mature example to follow Co-parenting creates an environment where children can develop healthily, both emotionally and mentally Although the process of divorce is stressful, there are options for you and your family post-separation. If you’re ready to divorce, our Family Law team is here to help every step of the way.

Are you in a common-law marriage? Whether or not a live-in relationship can be considered a common-law marriage generally depends on the amount of time that the couple has been living together. In B.C., a common-law relationship requires only two years of cohabitation in a marriage like relationship. Individuals in common-law marriages are not considered to be formally married, but the rights afforded to common-law partners during a separation are generally the same as those... afforded to individuals who have been married in a formal ceremony or through a civil procedure. If you have recently separated from your common-law partner, it is wise to speak to an experienced Family Law lawyer. This is particularly true in instances of common law relationships that involve children. Our lawyers can help you understand your rights and obligations in common law relationships, and what to do when you want to dissolve one in B.C. Contact us for a consultation.

McQuarrie 20.08.2020

The division of common law relationships can be difficult, especially if there is property or other significant assets involved. In B.C., property division rules apply to couples who have lived together for two years or more. This means that common law couples will typically share any property or resources that have been acquired over the course of their relationship, but not assets that have been individually brought into the relationship. Going through a separation is never easy and if you are in the midst of one, you may be understandably exhausted, discouraged, and overwhelmed. Every relationship and family is unique. That's why our Family Law Lawyers take a methodical and focused approach to dealing with your situation. Contact us today if you require legal advice. 604.581.7001

Going to court for a divorce is not only time-consuming and expensive - it's stressful for all parties involved. When children come into play, it’s even more difficult to remain calm and foster the cooperation that will be necessary for a healthy post-separation parenting relationship. Going to court also means that the decisions that directly impact you and your children are removed from your immediate control. Alternative Dispute Resolution allows for a direct negotiation between both partners and their lawyers. Nothing is out of your hands, and you have the option to say no to any agreement or provision. If you are interested in alternative dispute resolution or have any questions about it, please request a consultation with one of our lawyers. https://ecs.page.link/hrMj5

Getting in an accident can be extremely stressful, emotional, and sometimes traumatizing. Being prepared will save you a lot of headaches in the future. At the scene of the accident, here are a few things you should do: Keep a pen and paper in your vehicle with your insurance papers to help you keep a record of the accident particulars. If you have a smartphone, document the accident scene. Include license plates, vehicles involved, witnesses names and phone numbers.... This evidence is critical to supporting your case for proper compensation. Remember that your health and safety is of utmost importance. If you are injured, stay put and ask for emergency assistance. The police will gather the necessary information about the other driver(s) and any witnesses.

Did you know that child support and child custody obligations in a common-law marriage are identical to a regular marriage? When it comes to common law relationships that involve children, the law attempts to approach these issues from the viewpoint of the child whenever a decision is being made that will impact that child’s life and security.
