CanLII: The Canadian Legal Information Institute, is an invaluable and free resource for anyone who needs to look up Canadian caselaw, statutes, or commentary. I just discovered they have a YouTube channel. I immediately subscribed and I hope you do too.
Please like and share if you agree. Covid-19 has closed many courts, it is likely many more courts will close as things develop. Viruses are very persistent, and we will never live in a world free of them.... We have been too complacent for too long and it is time for us to step up and reform the justice system to deal with this reality. The time has come for the justice system to operate virtually. This is long overdue. It is only because of convention that we go to court in person, file documents on paper, and schedule matters in person in a courtroom as well. The supreme irony of this situation is we all already own the technology: laptops and phones with cameras, free software that allows us to connect by audio and video from any point in the world with an Internet connection to any other point in the world with an Internet connection, plus the means to file any needed documents electronically. By using this existing and proven technology, we can improve access to justice, lower our carbon footprint, and massively speed up a system where a constant complaint is its slowness. In fairness, BC has created the Civil Resolution Tribunal, which is a limited step in the right direction. However, we need to implement similar reforms across the system, and we need to do it now. Some might say that technology is but one aspect, and not the most important one, in making the justice system more accessible. I cannot agree. I feel it is THE most important factor and, in most cases, if we do not get technology right, we will not get anything else right either. Everything is ready to go, the question is, will the justice system rise to the challenge, or continue to wallow in the past?
This may not be the pay we deserve but I consider it a great achievement that we got anything at all. In addition, we finally have an organization to represent the interests of Legal Aid Lawyers and therefore the most marginalized in our communities.
I love good podcasts and as far as Canadian law goes Stereo Decisis is great! The name is a cute pun on the legal term "stare decisis", a Latin term referring to the legal principle that lower courts must follow the decisions of upper courts. The podcast is thoughtful and about as light as a legal podcast could be. Check it out!

The lack of legal aid funding is not only unjust, it winds up costing the taxpayer more! I will stand with my fellow lawyers in this action.

On this spooky day it is worth mentioning that it is still a crime in Canada to "Pretend to practise witchcraft, etc." under section 365 of the Criminal Code. It appears that soon this section, and some other old fashioned ones, will be repealed. Till then, be safe, and, if you are charged with a crime, obtain advice from a lawyer as soon as you can!
As a member of ALL and a lawyer who regularly takes on legal aid, I hope the government acts soon!
I found this lawyer randomly on YouTube. Apparently he is a practicing attorney from the Washington, D.C. area. His videos consistently demonstrate the false sense of security locks often give us. See here how quickly he gets into a gun box with a low tech, brute force attack.
I do not do Civil Practice as a rule but I tend to agree that it is not the place of the courts to declare that Sasquatch exists.

I posted before that a lot of my job has to do with words. I realize now that I was too digital centric when I said that. A better term than words would have been language. I came to this conclusion when reading about some court cases (link) where decisions were based in part on the interpretation of a new standard in ‘written’ communication: Emoji . ... The Emoji above roughly mean I am thinking; one needs to think in a different way when one is dealing with Ideograms, as opposed to a Symbolic Alphabet. Per the English Wikipedia headnote, the word emoji comes from Japanese e (, "picture") + moji (, "character"). The resemblance to the English words emotion and emoticon is purely coincidental. What was purely coincidental as well was my resolution a few weeks ago to attain at least basic literacy in Emoji. That is an ongoing project .
