July 10, 2017 Hamilton, Ontario Judicial Review sought for PC Nomination Meeting for Hamilton West-Ancaster-Dundas PC Party Candidate-nominee Jeff Peller has commenced a court application alleging that the May 7th Nomination Meeting held in Ancaster was tainted and improper. Peller seeks a Court Order requiring that a new Nomination Meeting be held under the supervision of an independent auditor. The Application contains allegations which have yet to be proven in Court. Th...e Application alleges that the Nomination Meeting that occurred on May 7, 2017 at Ancaster High School to select a candidate to run in the upcoming Ontario General Election was administered in a manner that disregarded principles of democracy and brought the integrity of the democratic institution into disrepute. The Application alleges that instances of bias, procedural fairness, ballot counting impropriety, voter delay and fraudulent voting practices tainted the meeting and manifestly affected its outcome in declaring Benjamin Levitt the successful nominee. The Nomination Meeting is a reflection of the democratic institution in Canada. The benchmark standard of the PC Party is to ensure a nomination meeting is administered in the most fair, open and democratic manner possible. The Application alleges that this standard was not met by the PC Party. The events that transpired at the Nomination Meeting call into question the integrity of our democratic system. The Application alleges that the decision by Patrick Brown, in ratifying and promoting Benjamin Levitt as the candidate for the Hamilton West-Dundas-Ancaster Riding is unreasonable given the circumstances and cannot stand as a valid exercise of authority. A copy of the Notice of Application for Judicial Review is attached. David Thompson, Gary Kuzyk and Paul Ingrassia of Scarfone Hawkinss LLP are representing Mr. Peller.
