A teenaged girl and her family were at the Supreme Court in P.E.I. Monday to describe the lasting harm caused by sexual abuse the girl experienced. Aaron Philip... Crane, 36, pleaded guilty in September to sexual interference against the girl. She was under 16 at the time of the abuse. Charges of sexual assault and sexual exploitation were stayed by the Crown. Monday's hearing was an opportunity for the judge to hear the victim impact statements and for lawyers to recommend an appropriate sentence for Crane. Crane had been an actor, musician and private music teacher in Charlottetown. NOVA SCOTIA A Dartmouth man who has been on remand for more than 20 months has been given a further 254 days in jail, followed by two years’ probation, after a...ccepting responsibility for a half-dozen criminal offences involving young women who were being pimped out by his family. Andre Jerome Gray, 24, pleaded guilty this summer in Halifax provincial court to two charges of sexual assault and single counts of intimidating a justice system participant, receiving material benefits from human trafficking, breaching probation and breaching a court order. He was sentenced last week by Judge Perry Borden, who accepted a joint sentencing recommendation from lawyers for a 42-month sentence less remand credit. Borden agreed with counsel that Gray should get an additional reduction of about 4.5 months in recognition of the harsh conditions he endured while in solitary confinement for 267 days. A Nova Scotia Supreme Court judge ruled this summer that Gray’s time in segregation at the Dartmouth jail was unlawful and had to end. In his sentencing decision, Borden said he was initially somewhat taken aback by the shortness of the recommended jail term. But for the joint recommendation, I would have done something completely different than what counsel were suggesting here today, he said. Borden said his acceptance of the joint recommendation was driven by the trauma Gray was exposed to during his adolescence and early adulthood. That trauma, the judge said, included seeing his cousin die after a shooting in North Preston in 2011, and his experience within the criminal justice system. It’s unfortunate that you’ve experienced the sort of remand time that you’ve experienced, Borden told Gray. Suffice it to say your time on remand has been noticeably different than other people who are on remand while awaiting trial or sentencing. In the circumstances, I will agree with counsel that what is being proposed is a fit and appropriate disposition, however, it is on the fringe of the low end (of the range). Gray committed the offences between March 2018 and April of this year. The judge said the most aggravating crimes were the sexual assaults one involving rape and the other touching on two young women working in the sex trade. Gray was on probation at the time. He also admitted taking a portion of the money earned by one of the women on one occasion. In addition, Gray pleaded guilty to phoning a third woman from jail last February in an attempt to convince her not to testify against members of his family who were awaiting trial on human trafficking charges, and to having more contact with her in March and April. Crown attorney Cory Roberts said Gray came before the court with a significant criminal record, including nine convictions for violent offences. In April 2014, Gray was charged with human trafficking, sexual assault and other offences after a 15-year-old girl said she was held against her will in the basement of a home in North Preston. Rather than go to trial, he pleaded guilty to charges of assault and forcible confinement and was sentenced in February 2016 to time served. In March 2017, Gray and one of his older brothers, Leslie Burton Gray, were arrested on allegations of forcing a young woman to engage in prostitution and profiting from her sexual services. Andre Gray pleaded guilty that November to uttering threats and was sentenced to time served and three years’ probation. Last March, Leslie Gray and three other members of his family brother Justin, mother Robin and sister Laura were sentenced in Halifax provincial court on a variety of pimping-related charges. Leslie Gray pleaded guilty to four counts of human trafficking and was sentenced to seven years in prison less remand credit, leaving him with a net sentence of five years and almost six months. Justin Gray was handed a sentence of five years and one month on his charges, which include two counts of receiving financial benefit from human trafficking and single counts of human trafficking and breaching a court order by repeatedly contacting one of the victims from jail. Robin Gray was sentenced to two years in prison after pleading guilty to three charges of receiving financial benefit from human trafficking. That was on top of the time she’d spent in custody since July 2019. Laura Gray received a conditional sentence of two years less a day, followed by two years’ probation. She pleaded guilty to assaulting one of the complainants and possessing more than $5,000 in property obtained by the commission of an indictable offence. Borden noted that Andre Gray was given up by his biological mother at an early age and after reuniting with his family many years later, mimicked their criminal behaviour. I would simply suggest to you, sir, that that type of path has no future for you, the judge told Gray. While on probation, Gray must take part in any counselling deemed necessary by his probation officer and is not allowed to have contact with the three victims. WYNYARD, SASK. -- A former Saskatchewan teacher accused of sexually assaulting at least five students received his verdict in court on Friday. Gerard Loehr, 57,... appeared in Wynyard Provincial Court facing five counts of sexual assault and six counts of sexual interference on Nov. 13. The judge found Loehr guilty on three counts of sexual assault and not guilty on six counts of sexual assault and sexual interference. The sexual assault allegation, dating back 30 years, was reported to the Wynyard RCMP this past February, followed by four additional victims coming forward to allege similar experiences. Police said the victims were allegedly assaulted while Loehr worked as a music teacher at various schools within the Shamrock School Division, including Wynyard and Foam Lake schools between 1990 and 1995. A sentencing date will be determined on Nov. 23. Loehr, who is from Ottawa, was arrested there in August and charged with five additional counts of sexual assault and sexual interference involving five people dating back to 2000. In December 2019, police laid a dozen new sex charges after six more people came forward with allegations. The sentencing hearing of former Fredericton radio host Trevor Leslie Doyle has been pushed into new year because of concerns over the COVID-19 virus. "The cou...rt finds that this hearing cannot be conducted in person in this district without seriously jeopardizing public health and safety," said a court document from last week. Doyle has pleaded guilty in San Juan court in February to one count of travel with the intent to engage in illicit sexual conduct with a 14-year-old girl. He has been held in Puerto Rico since his arrest in early April, 2019. Doyle's sentencing is now scheduled to take place on Jan. 13 before Judge Raul M. Arias-Marxuach. Chief Judge Gustavo Gelpi had issued an order allowing a sentencing hearing to proceed via video conference so long as the defendant waives his right to be physically present. Doyle did not waive that right. He was originally scheduled to be sentenced this past May, but through his lawyer, requested a continuance of the hearing for summer, and sentencing was set for mid-September. However, the federal public defender filed a motion on Doyle's behalf seeking to postpone the hearing "at least sixty (60) days," according to the court filing. He was scheduled to be sentenced on Nov. 20, until the most recent order from a judge changed the date to January. The charge of travel with intent to engage in illicit sexual conduct carries a maximum sentence of 30 years in prison, but the defence and prosecution recommended Doyle be sentenced to 70 to 87 months. A 35-year-old man has been sentenced to 30 months in prison after pleading guilty to charges stemming from an investigation into images of child sexual abuse. T...he investigation began in February 2019, as a result of information received from the RCMP's National Child Exploitation Crime Centre. On July 24, 2019, a search warrant was executed at a residence in Fredericton. Police seized several electronic devices and a 35-year-old man was arrested at the scene. On December 18, 2019, William Logan Murphy was charged in Fredericton Provincial Court with possession of child pornography and accessing child pornography. On November 6, 2020, William Logan Murphy appeared in Fredericton Provincial Court and was sentenced to 30 months for possession of child pornography and 18 months for accessing child pornography. The sentences will be served concurrently. William Logan Murphy has been added to the National Sex Offender Registry for life, and will be required to submit a DNA sample. Following his release from prison, he will have to abide by conditions set out by the court, including not being around children. The RCMP's Internet Child Exploitation Unit includes members of the Saint John and Kennebecasis Regional Police Forces. A 53-year-old man has been sentenced to 54 months in prison after pleading guilty to charges stemming from an investigation into images of child sexual abuse. T...he investigation began in July 2019, as part of a proactive investigation by the RCMP's Internet Child Exploitation Unit. On January 16, 2020, a search warrant was executed at a home in Lincoln, N.B. Police seized several electronic devices and a 53-year-old man was arrested at the scene. On June 1, Robert Allan Love was charged in Fredericton Provincial Court with possession of child pornography and making available child pornography. On November 20, 2020, Robert Allan Love returned to court and was sentenced to 36 months for possession of child pornography and 54 months for making available child pornography. The sentences will be served concurrently. Robert Allan Love has been added to the National Sex Offender Registry for life, and will be required to submit a DNA sample. Following his release from prison, he will have to abide by conditions set out by the court, including not being around children. The RCMP's Internet Child Exploitation Unit includes members of the Saint John and Kennebecasis Regional Police Forces. David James Leblanc, 55, was convicted of several crimes, including making and distributing child pornography, sexual interference, kidnapping, forcible confinement, sexual assault and uttering death threats. In September 2012, Leblanc and another man kidnapped a teenage boy and took him to a cabin in the woods of Lunenburg County. There the boy was stripped and chained to the floor and ceiling. Over the course of days, the boy was raped repeatedly. Leblanc's accomplice even arranged for another man to sexually assault the boy. That man, John Leonard MacKean, was convicted of sexually assaulting the boy and sentenced to two years in prison, where he died of natural causes. Released in April When the teen managed to escape the cabin, Leblanc and his accomplice, Wayne Cunningham, fled. They ended up in northern Ontario where Cunningham died and Leblanc was found suffering from exposure. Leblanc was released from prison this April after serving two-thirds of his sentence. He was living in a halfway house in British Columbia under tight restrictions, which included that he not buy or consume alcohol. In September, a search of Leblanc's room uncovered about 30 receipts for alcohol purchases. When confronted with that information, Leblanc denied consuming alcohol and said he only bought it to be "nice" to his roommate. In a meeting last Friday, the Parole Board of Canada rejected that explanation. Authorities also discovered a penis pump. 'Facade of credibility' "The Board asked why you had a penis pump in your room given your earlier statement that you had no sex drive," the parole report noted. "You said you need to use the penis pump for sexual gratification but you had not used it with the roommate nor when the roommate was present." Ilunga, was also convicted of distribution of intimate images. The young woman was terrorized after Ilunga plotted revenge out of jealousy. Ilunga had learned that her target had been dating her ex-boyfriend. This is nothing short of a vicious, terrifying attack, Assistant Crown Attorney Louise Tansey told presiding Superior Court Justice Robert Smith at the sentencing hearing. Tansey, who currently specializes in sex-crimes prosecutions, noted that the victim, some five years later, is still stuck in that living hell. The brutality is chilling, Tansey told court. A woman who survived human trafficking has launched a not-for-profit organization that aims to provide free removal of tattoo branding on victims of the sex tra...de. Human traffickers can use many tactics to control their victims, which can include branding tattoos or marks. It signifies that that victim belongs to that trafficker, so she’s his property, so other traffickers and other girls will know that she belongs to him, Rhonelle Bruder said. It creates many barriers [to] healing, but also for employment. A lot of these branding tattoos will be in very visible places this is intentional by the traffickers so maybe on a neck, it’s on your hand. I’ve even seen some on a young person’s face. Bruder, who started a crowdfunding page for people to donate to help cover the costs of the branding removal, was a victim of human trafficking as a child. At the age of 16, she found herself homeless and lured into the sex industry by a pimp or human trafficker. After a few months, Bruder was able to escape from her trafficker and turned her life around. It’s such a relational crime because they do something we call ‘love bombing’ where they take you out to dinner, they buy you nice things, tell you they love you. They give you everything that you need, she said. For more than a decade, Bruder has been raising awareness as an anti-trafficking expert and motivational speaker in the health-care community. During the COVID-19 pandemic, she launched Project iRISE, a community based, not-for-profit organization that connects survivors of human trafficking to help rebuild and heal their lives. The organization provides innovative skills-based training and education and services for survivors of human trafficking to help them rebuild their lives. I wanted to develop my own program for survivors for a while, but it wasn’t until COVID-19 stuck that I had the time to dedicate to building the non-profit and assembling a team to support this work, she said. According to Statistics Canada, human trafficking is one of the fastest-growing crimes in the world. It involves recruiting, transporting, transferring, receiving, holding, concealing or harbouring, or the exercise of control, direction, or influence over the movements of a person, in order to exploit or facilitate the exploitation of that person. According to government statistics, 97 per cent of human trafficking victims are women and girls and 73 per cent of these victims are under the age of 25. Meanwhile, Bruder said having conversations about healthy relationships, boundaries, consent, social media, and how the internet works is critical, especially during a global pandemic where a lot of these young people are spending time online, where predators are connecting with them the most. https://globalnews.ca//7/human-trafficking-project-irise/
