HOLOGRAPHIC WILLS IN ONTARIO For those of you that may be feeling anxious about estate planning during these uncertain times: Hand written Wills known as holographic Wills are valid in Ontario. They have been recognized historically in times of urgency.... Holographic wills cannot contain any printed forms and must be 100% in your own writing. The entire Will must be in your own hand writing 1. There must be evidence that the testator actually created the will, which can be proved through the use of witnesses, friends, other handwritten documents that verify identity or other methods;. You can also record yourself hand writing your Will on your smart phone and send it to your executor (person you are putting in charge to manage your affairs). 2. The testator must have had the intellectual capacity to write the Will, although there is a presumption that a testator had such capacity unless there is evidence to the contrary; A video detailing date, time and intention of Will can help identify this. 3. The testator must be expressing a wish to direct the distribution of his estate to beneficiaries. 4. You should name a trustee/executor who would handle your affairs. 5. You must sign and date it yourself.
